Op grond van artikel 12 van Richtlijn 2011/24/EU moet de Commissie de lidstaten steunen bij de ontwikkeling van Europese referentienetwerken („netwerken”) van zorgaanbieders en expertisecentra in de lidstaten, met name op het gebied van zeldzame ziekten .
Article 12 of Directive 2011/24/EU provides that the Commission is to support the Member States in the development of European Reference Networks (‘Networks’) between healthcare providers and centres of expertise in the Member States, in particular in the area of rare diseases .

De netwerken berusten op de vrijwillige deelname van hun leden die deelnemen aan de activiteiten van het netwerk en ertoe bijdragen volgens de wetgeving van de lidstaat waar de leden zijn gevestigd, en zij staan voortdurend open voor nieuwe zorgaanbieders die eraan willen deelnemen, mits deze zorgaanbieders voldoen aan alle vereiste voorwaarden en criteria die worden genoemd in lid 4.
The networks shall be based on voluntary participation by its members, which shall participate and contribute to the networks’ activities in accordance with the legislation of the Member State where the members are established and shall at all times be open to new healthcare providers which might wish to join them, provided that such healthcare providers fulfil all the required conditions and criteria referred to in paragraph 4.

3. Teneinde patiënten in staat te stellen om gebruik te maken van hun rechten op grensoverschrijdende gezondheidszorg verstrekken de nationale contactpunten in de lidstaat waar de behandeling plaatsvindt, hen informatie over de zorgaanbieders, waaronder, op hun verzoek, informatie over het recht van een specifieke zorgaanbieder om diensten te verlenen of mogelijke beperkingen ten aanzien van zijn praktijk, de in artikel 4, lid 2, onder a), bedoelde informatie, en informatie over patiëntenrechten, klachtenregelingen en rechtsmiddelen overeenkomstig de wetgeving van de lidstaat, alsook informatie over de wettelijke en bestuursrechtelijke opties om geschillen te beslechten, onder meer als schade ontstaat als gevolg van grensoverschrijdende gezondheidszorg.
3. In order to enable patients to make use of their rights in relation to cross-border healthcare, national contact points in the Member State of treatment shall provide them with information concerning healthcare providers, including, on request, information on a specific provider’s right to provide services or any restrictions on its practice, information referred to in Article 4(2)(a), as well as information on patients’ rights, complaints procedures and mechanisms for seeking remedies, according to the legislation of that Member State, as well as the legal and administrative options available to settle disputes, including in the event of harm arising from cross-border healthcare.

Voor zover zorgaanbieders patiënten die wonen in de lidstaat waar de behandeling plaatsvindt, hierover al de nodige informatie verstrekken, verplicht deze richtlijn de zorgaanbieders niet patiënten uit andere lidstaten uitgebreider voor te lichten;
To the extent that healthcare providers already provide patients resident in the Member State of treatment with relevant information on these subjects, this Directive does not oblige healthcare providers to provide more extensive information to patients from other Member States;

Voor zover zorgaanbieders patiënten die wonen in de lidstaat waar de behandeling plaatsvindt, over die specifieke aspecten al de nodige informatie verstrekken, dient deze richtlijn de zorgaanbieders niet te verplichten patiënten uit andere lidstaten uitgebreider voor te lichten.
