IN-CONTEXT TRANSLATIONS

In de aanhef van haar voorstel heeft de Commissie het volgende opgenomen: "On 22 July 2015 the rapporteur Member State indicated its intention to submit a dossier concerning the harmonised classification of glyphosate under Regulation (EC) No 1272/2008, in accordance with Article 37 of that Regulation, including for the hazard class on carcinogenicity.
La Commission a inséré ce qui suit en préambule à sa proposition: "On 22 July 2015 the rapporteur Member State indicated its intention to submit a dossier concerning the harmonised classification of glyphosate under Regulation (EC) No 1272/2008, in accordance with Article 37 of that Regulation, including for the hazard class on carcinogenicity.

Bijzonder belangrijk hierbij zijn de volgende overwegingen van de Commissie die de volgende beginselen herhaalt (nrs. 3 en 6) : « Recalls that, in accordance with article 4 of the International Covenant on Civil and Political Rights, certain rights are recognized as non derogable in any circumstances and that any measures derogating from the provisions of the Covenant must be in accordance with that article in all cases, and underlining the exceptional and temporary nature of any such derogations en Reaffirms that it is imperative that all States work to uphold and protect the dignity of individuals and their fundamental freedoms, as well as democratic practices and the rule of law, while countering terrorism (...)».
À cet égard, on relèvera tout particulièrement l'importance des considérations de la Commission qui rappelle les principes suivants (nºs 3 et 6): « Rappelle qu'en vertu de l'article 4 du Pacte international relatif aux droits civils et politiques, certains droits ne sont susceptibles de dérogation en aucune circonstance et que toute dérogation aux dispositions du Pacte doit être en conformité avec cet article dans tous les cas, et soulignant le caractère exceptionnel et provisoire d'une telle dérogation, réaffirme qu'il est indispensable que tous les États, dans la lutte antiterroriste, s'efforcent d'affirmer et de protéger la dignité des individus et leurs libertés fondamentales, ainsi que les pratiques démocratiques et la primauté du droit (...)».

5. recalls that, in accordance with Article 19 of the Charter of Fundamental Rights of the European Union, which is an integral and legally binding part of European law, no one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment », and that « collective expulsions are prohibited »; insists that all migration legislation must comply with this inalienable principle;
5. rappelle que, selon l'art.19 de la Charte des Droits Fondamentaux de l'Union Européenne, partie intégrante et contraignante de la législation européenne, « nul ne peut être éloigné, expulsé ou extradé vers un État où il existe un risque sérieux qu'il soit soumis à la peine de mort, à la torture ou à d'autres peines ou traitement inhumains ou dégradants », et que « les expulsions collectives sont interdites »; exige que toute législation en matière de migration se conforme à ce principe inaliénable;

6. welcomes the achievements of the EuroMed Summit of Economic and Social Councils and Similar Institutions, held in Rome on 10-12 November 2010, whose final declaration is of the utmost importance, and the establishment of the UfM Assembly of Economic and Social Councils and Similar Institutions, which, according to Article 1(1) of its statue, « intends to serve as the expression of organised civil society with consultative powers in the Union for the Mediterranean »;
6. salue les accomplissements du Sommet Euromed des Conseils économiques et sociaux et institutions similaires tenu à Rome les 10-12 novembre 2010, dont la Déclaration finale constitue un document de la plus grande importance, ainsi que la constitution de l'Assemblée des Conseils économiques et sociaux et institutions similaires de l'UpM, qui selon l'article 1,1 de son Statut « se propose d'être l'expression de la société civile organisée, dotée d'un pouvoir consultatif auprès de l'Union pour la Méditerranée »;
