Volgens professor Krysztof Krajewski zijn in het kader van de verdragen van 1961 en 1971 zowel depenalisatie als decriminalisering toelaatbaar, doch laat het verdrag van 1988 enkel de depenalisering toe : « Unfortunately, implementation of more rational drug policy, including not only eventual legalisation, but also decriminalisation, would require probably amending the 1988 Convention, first of all repelling its Article 3, paragraph 2» (38)
