Art. 9. ­ Bij de exploitatie van de HST-infrastructuur verleent HST-Bel toegang tot het HST-net aan alle operatoren die voldoen aan de voorwaarden vastgesteld bij een in Ministerraad overlegd koninklijk besluit.
Art. 9. ­ Dans le cadre de l'exploitation de l'infrastructure T.G.V. , T.G.V. -Bel accorde l'accès au réseau T.G.V. à tous les opérateurs qui satisfont aux conditions établies dans un arrêté royal délibéré en Conseil des ministres.

Om in dergelijk beheer te voorzien, dient duidelijk gesteld waarover dit dossier in concreto gaat : het verzamelen van de financieringsmiddelen van de investeringen nodig om de HST-infrastructuur aan te leggen en, ter uitvoering daarvan uiteraard, de aanleg en exploitatie van het HST-net.
Afin d'assurer une telle gestion, il convient de préciser sur quoi ce dossier porte concrètement : le rassemblement des moyens financiers permettant de réaliser les investissements nécessaires pour aménager l'infrastrucutre T.G.V. et, par la suite évidemment, la construction et l'exploitation du réseau T.G.V.

Art. 2. ­ De Federale Participatiemaatschappij (de « FPM ») en de Nationale Maatschappij der Belgische Spoorwegen (de « NMBS ») worden ertoe gelast om, binnen 60 dagen na de datum van inwerkingtreding van deze wet, een naamloze vennootschap, « HST-Bel » genaamd, op te richten, welke tot doel zal hebben de verwezenlijking van de HST-infrastructuur, de aanschaffing van het rollend materieel en de exploitatie van de hoge snelheidslijnen op het Belgische grondgebied.
Art. 2. ­ La Société fédérale de participations (S.F.P) et la Société nationale des Chemins de fer belges (S.N.C.B) sont chargées de constituer, dans les soixante jours suivant la date d'entrée en vigueur de la présente loi, une société anonyme, dénommée « T.G.V. -Bel », dont l'objet sera la réalisation de l'infrastructure T.G.V. , l'acquisition du matériel roulant et l'exploitation des lignes à grande vitesse sur le territoire belge.

3. Overigens wordt de overheidsfinanciering van de collectieve spoorweginfrastructuur (d.w.z. open voor alle potentiële gebruikers die er volgens de communautaire wetgeving toegang toe dienen te hebben) in het algemeen door de Europese Commissie niet aanzien als overheidssteun ten voordele van de spoorwegondernemingen ( zie o.a. de beslissingen van de Commissie in de dossiers Ferrovie dello Stato en Öresund, Verslag XXV over het concurrentiebeleid 1995, p. 85, nr.175, de brief van de Commissie van 14 januari 1997 betreffende de financiering van de Belgische HST infrastructuur, de Mededeling van de Commissie : Communautaire Richtlijnen voor de Overheidssteun aan Spoorwegondernemingen, PB nr. 184, 22 juli 2008, p.17, punt 25).
3. Par ailleurs, de manière générale, le financement public d'infrastructures ferroviaires collectives (c'est-à-dire ouvertes à tous usagers potentiels qui doivent y avoir accès selon la législation communautaire) est considéré par la Commission européenne comme ne constituant pas des aides d'Etat en faveur d'entreprises ferroviaires (voy., entre autres, les décisions de la Commission dans les dossiers Ferrovie dello Stato et Öresund, XXVe Rapport sur la politique de concurrence 1995, p. 85, n° 175, la lettre de la Commission du 14 janvier 1997 relative au financement de l'infrastructure TGV belge, et Communication de la Commission : Lignes directrices communautaires sur les aides d'Etat aux entreprises ferroviaires, JO n° C184, 22 juillet 2008, p. 17, point 25).

- oprichting, bij het bijzonderemachtenbesluit (1) van 14 juni 2004 tot hervorming van de beheersstructuren van de spoorweginfrastructuur (2), van een instelling van openbaar nut van categorie B, " Fonds voor spoorweginfrastructuur" genaamd, bestemd om de eigendom te verkrijgen van deze infrastructuur, waaronder de HST-infrastructuur (3), en de eraan verbonden passiva,
- création, par l'arrêté royal de pouvoirs spéciaux (1), du 14 juin 2004 portant réforme des structures de gestion de l'infrastructure ferroviaire (2), d'un organisme d'intérêt public de catégorie B, dénommé " Fonds de l'infrastructure ferroviaire" , et destiné à recueillir la propriété de cette infrastructure, en ce compris l'infrastructure TGV (3), et le passif y afférent,

- oprichting, bij het koninklijk besluit van 14 juni 2004 tot hervorming van de beheersstructuren van de spoorweginfrastructuur (2) (3), van een instelling van openbaar nut van categorie B, " Fonds voor spoorweginfrastructuur" genaamd, bestemd om de eigendom te verkrijgen van deze infrastructuur, waaronder de HST-infrastructuur (4) en de eraan verbonden passiva,
- création, par l'arrêté royal du 14 juin 2004 portant réforme des structures de gestion de l'infrastructure ferroviaire (2) (3), d'un organisme d'intérêt public de catégorie B, dénommé " Fonds de l'infrastructure ferroviaire" , et destiné à recueillir la propriété de cette infrastructure, en ce compris l'infrastructure TGV (4), et le passif y afférent,

Overwegende dat de federale Regering op 17 oktober 2000 bevestigd heeft dat de volledige HST-infrastructuur verwezenlijkt dient te worden van grens tot grens;
Considérant que le Gouvernement fédéral a confirmé le 17 octobre 2000, qu'il convenait de réaliser l'intégralité de l'infrastructure TGV de frontière à frontière;

Overwegende dat de federale Regering op 29 mei 1998 bevestigd heeft dat de volledige HST-infrastructuur verwezenlijkt dient te worden van grens tot grens, inbegrepen de nieuwe lijn voorbij Luik;
Considérant que le Gouvernement fédéral a confirmé le 29 mai 1998, qu'il convenait de réaliser l'intégralité de l'infrastructure TGV de frontière à frontière, en ce compris la ligne nouvelle au-delà de Liège;
