Doel van dit amendement is te bepalen dat de IVZW rechtspersoonlijkheid verkrijgt vanaf de datum van het koninklijk besluit. Dit sluit aan bij de rechtsleer terzake (zie D. Lontings, L'association internationale sans but lucratif, RDAI, 1994, nr. 5, blz. 606-607; D. Lontings, « The practice of the Ministry of Justice regarding international non-profit associations », in Driekwart eeuw internationale vereniging in België en haar alternatieven, Mys & Breesch, 1996, blz. 16-18).
L'objectif du présent amendement, qui s'aligne à la doctrine en la matière (voir D. Lontings, L'association internationale sans but lucratif, RDAI, 1994, nº 5, pp. 606-607; D. Lontings, « The practice of the Ministry of Justice regarding international non-profit associations », dans « Driekwart eeuw internationale vereniging in België en haar alternatieven », Mys & Breesch, 1996, pp. 16-18), est de souligner que la personnalité juridique est acquise par l'AISBL à la suite de l'arrêté royal intervenu.
