Maar dit is ook uitdrukkelijk het geval met betrekking tot vrouwen in onder meer de Zweedse Grondwet (Artikel 16 : No Act of law or other statutory instrument may entail the discrimination of any citizen on grounds of sex, unless the relevant provision forms part of efforts to bring about equality between men and women or relates to compulsory military service or any corresponding compulsory national service), de Indische Grondwet (Artikel 12(4) : Nothing in this Article shall prevent special provision being made by law, subordinate legislation or executive action for the advancement of women, children or disabled persons) en de Finse Grondwet (Artikel 5, laatste lid : Equality of the sexes shall be promoted in social activities and in working life, particularly in the determination of remuneration and other terms of service, in a manner more precisely by Act of Parliament).

Lawson en Schermers stellen in hun commentaar op een van de mijlpaalarresten van het EHRM, met name S.W. versus Groot-Brittannië van 22 november 1995, het volgende (4) : « Expanding upon the reference in Article 7 § 1 of the European Convention on Human Rights to « crimes .under international law », paragraph 2 of Article 7 makes it possible to punish a person for an act which, at the time it was committed, was « criminal according to the general principles of law recognised by civilised nations », even though it was not classified as a criminal offence under national law.
