Het gegeven dat het Hof van Justitie in zijn beoordeling rekening kan houden met de bijzondere situatie van regio's met constitutionele autonomie (zie K. LENAERTS en N. CAMBIEN, "Regions and the European Courts: Giving Shape to the Regional Dimension of Member States", European Law Review 2010, 609-635), betekent nog niet dat zonder meer voorbij kan worden gegaan aan de zo-even geschetste mogelijke selectiviteit van de ontworpen steunmaatregel, aangezien vooral de feitelijke effecten van de maatregel bij die beoordeling doorwegen.

CAMBIEN, "Regions and the European Courts: Giving Shape to the Regional Dimension of Member States", European Law Review 2010, 609-635) ne signifie pas pour autant que l'on puisse tout simplement ignorer la sélectivité éventuelle précitée de la mesure d'aide en projet, des lors que ce sont surtout les effets réels de la mesure qui influencent cette appréciation.

Er is wel een politiek akkoord over de mogelijkheid voor een uitzondering in specifieke omstandigheden: "Member States may grant exemptions from the measures imposed in paragraph 1 where travel is justified on the grounds of urgent humanitarian need, or in exceptional cases on grounds of attending intergovernmental meetings and those promoted or hosted by the European Union, where a political dialogue is conducted that directly promotes the policy objectives of restrictive measures, including democracy, human rights and the rule of law in Zimbabwe".
Il y a bien un accord politique sur la possibilité d'une exception dans des circonstances spécifiques : " Les États membres peuvent accorder des dérogations aux mesures visées au paragraphe 1 lorsque le déplacement d'une personne se justifie pour des raisons humanitaires urgentes ou, exceptionnellement, lorsque la personne se déplace pour assister à des réunions intergouvernementales et à des réunions dont l'initiative a été prise par l'Union européenne ou qui sont organisées par celle-ci, lorsqu'il y est mené un dialogue politique visant directement à promouvoir les objectifs politiques ou des mesures restrictives, y compris la démocratie, les droits de l'homme et l'état de droit au Zimbabwe".

The provisions concerning financial actors shall be without prejudice to any liability under criminal law which the authorising officer and his/her delegates may incur as stipulated in the applicable national law and in the provisions in force on the protection of the EU's financial interests and on the fight against corruption involving officials of the EU or of Member States.

16.
