« 1. Each Party shall adopt such legislative measures as may be necessary to establish the following conduct as criminal offences under its domestic law, when committed intentionally and without right : distributing or otherwise making available, through a computer system to the public, material which denies, grossly minimises, approves or justifies acts constituting genocide or crimes against humanity, as defined by international law and recognised as such by final and binding decisions of the International Military Tribunal, established by the London Agreement of 8 August 1945, or of any other international court established by relevant international instruments and whose jurisdiction is recognised by that Party.

L'article 6, 1º, du Protocole additionnel à la Convention sur la cybercriminalité invite les Parties à adopter les mesures législatives qui se révèlent nécessaires pour ériger en infractions pénales, dans leur droit interne, lorsqu'ils sont commis intentionnellement et sans droit, les comportements suivants: la diffusion ou les autres formes de mise à disposition du public, par le biais d'un système informatique, de matériel qui nie, minimise de manière grossière, approuve ou justifie des actes constitutifs de génocide ou de crime contre l'humanité, tels que définis par le droit international et reconnus comme tels par une décision finale et définitive du Tribunal militaire international, établi par l'Accord de Londres du 8 août 1945, ou par tout autre tribunal international établi par des instruments internationaux pertinents et dont la juridiction a été reconnue par cette Partie.

9. Noting that the Convention provides in Article 30, paragraph 2, that « [e]ach State Party shall take such measures as may be necessary to establish or maintain, in accordance with its legal system and constitutional principles, an appropriate balance between any immunities or jurisdictional privileges accorded to its public officials for the performance of their functions and the possibility, when necessary, of effectively investigating, prosecuting and adjudicating offences established in accordance with this Convention »,
9. Notant que la Convention stipule au paragraphe 2 de l'article 30 que « chaque État Partie prend les mesures nécessaires pour établir ou maintenir, conformément à son système juridique et à ses principes constitutionnels, un équilibre approprié entre toutes immunités ou tous privilèges de juridiction accordés à ses agents publics dans l'exercice de leurs fonctions, et la possibilité, si nécessaire, de rechercher, poursuivre et juger effectivement les infractions établies conformément à la présente Convention »,

Deplores the repeated postponement of the second UfM Summit, the cancellation of several ministerial and sectoral meetings, and the resignation on 26 January 2011 of the Secretary General of the UfM Secretariat; deplores the delay in the UfM's operational launch following the establishment of its secretariat; calls, therefore, on the Secretariat to finalise as soon as possible the regulatory framework establishing the criteria for project selection, funding methods, monitoring procedures and coordinating capacities; stresses the urgent need to clarify the rules on financial contributions by partner countries;
Déplore les reports successifs du second Sommet de l'UpM, l'annulation de plusieurs réunions ministérielles et sectorielles, puis la démission du Secrétaire général du Secrétariat de l'UpM le 26 janvier 2011; regrette le retard pris dans le lancement opérationnel de l'UpM après la mise en place du Secrétariat; invite par conséquent le Secrétariat à finaliser dans les meilleurs délais le cadre réglementaire définissant les critères de sélection des projets, les modalités de financement, les procédures de suivi et les capacités de coordination; insiste sur l'urgence de clarifier les règles concernant les contributions financières de chaque pays partenaire;

2. Mandaat en rol van ONUB Resolutie 1545 van 21 mei 2004, dat ONUB opricht, voorziet in haar operatieve para 5 volgende: «Authorizes ONUB to use all necessary means to carry out the following mandate, within its capacity and in areas where its armed units are deployed, and in coordination with humanitarian and development communities: (7e gedachtenstreepje): to contribute to the successful completion of the electoral process stipulated in the Arusha Agreement, by ensuring a secure environment for free, transparent and peaceful elections to take place; (8e gedachtenstreepje): without prejudice to the responsibility of the transitional government of Burundi, to protect civilians under imminent threat of physical violence».
2. Mandat et rôle de l'ONUB La Résolution 1545 du 21 mai 2004, qui crée l'ONUB, prévoit au paragraphe 5 du dispositif ce qui suit: «Autorise l'ONUB à utiliser tous les moyens nécessaires pour s'acquitter du mandat suivant, dans les limites de ses capacités et dans les zones de déploiement de ses unités armées, et en coordination avec les communautés humanitaires et du développement: (7e tiret): Contribuer au bon déroulement du processus électoral prévu par l'Accord d'Arusha en veillant à assurer un environnement sûr pour la tenue d'élections libres, transparentes et pacifiques; (8e tiret): Sans préjudice de la responsabilité du gouvernement burundais de transition, protéger les civils en danger immédiat de violence physique».
