In zijn antwoord verwees de staatssecretaris onder meer naar het principe "unfit to work". Dit principe staat ook beschreven in ESARR 5 (Eurocontrol Safety Regulatory Requirement). In artikel 5.3.3.1 kan men bijvoorbeeld het volgende lezen: "Not undertake safety related tasks if they know or suspect that their physical or mental condition renders them unfit to undertake such tasks".
Dans sa réponse, le secrétaire d'Etat s'est notamment référé au principe de l'"inaptitude au travail", également décrit dans l'ESARR 5 (Eurocontrol Safety Regulatory Requirement - Exigences réglementaires de sécurité Eurocontrol), dont l'article 5.3.3.1 est par exemple libellé comme suit: "Not undertake safety related tasks if they know or suspect that their physical or mental condition renders them unfit to undertake such tasks" (s'abstenir d'exercer des tâches liées à la sécurité s'ils sont en possession d'éléments tendant à démontrer que leur condition physique ou mentale les rend inaptes à l'exercice de ces tâches).

Welnu, het EHRM heeft meer dan eens en onder andere in het arrest Hristovi tegen Bulgarije van 11 oktober 2011 onderstreept : « Where the circumstances are such that the authorities are obliged to deploy masked officers to effect an arrest, the Court considers that the latter should be required to visibly display some anonymous means of identification — for example a number or letter, thus allowing for their identification and questioning in the event of challenges to the manner in which the operation was conducted » (§ 92).
Or, la Cour EDH a pu préciser à plusieurs reprises et notamment dans l'arrêt Hristovi c.
