For the public health reasons, the processing of such data is covered by the exemption granted by Article 8(3) of Directive 95/46/EC and Article 10(3) of Regulation (EC) No 45/2001, in so far as it is required for the purposes of preventive medicine, medical diagnosis and the provision of care or treatment or the management of health-care services, and where those data are processed by a health professional subject under national law or rules established by national competent bodies to the obligation of professional secrecy or by another person also subject to an equivalent obligation of secrecy.

Peuvent notamment être mentionnées, à cet égard, l’obligation faite aux parties à la convention d’établir le régime d’importation applicable aux produits soumis à cette procédure (article 10, paragraphes 1 à 5), la communication des éléments essentiels de ce régime à toute personne physique ou morale intéressée (article 10, paragraphe 8) ou l’obligation faite aux parties exportatrices d’assurer le respect, par les exportateurs relevant de leur juridiction, des régimes établis par les parties importatrices et, en particulier, d’interdire, sauf exceptions clairement circonscrites, toute exportation de produits inscrits à l’annexe III de la convention à destination d’une partie à celle-ci qui n’aurait pas communiqué au secrétariat le régime d’importation applicable à ces produits ou lui aurait seulement communiqué une réponse provisoire ne contenant pas de décision relative au régime d’importation provisoirement applicable [article 11, paragraphes 1, sous b), et 2].

10. Products for which intermediates have already been subject to the payment of an annual fee shall only be subject to payment of a fee corresponding to the annual sales of the products after deduction of the cost value of such intermediates.

Les produits résultant de la transformation ou de l'incorporation de demi-produits ayant déjà fait l'objet du paiement d'une redevance annuelle sont seulement soumis au paiement d'une redevance correspondant aux ventes annuelles du produit après déduction des coûts totaux actualisés de ces demi-produits.
