Considers that, in this new scenario, it is no longer possible to evade the need to revise and update the powers of the Committee on Fisheries defined in Annex VI to its Rules of Procedure, powers which date from the setting-up of the Committee on Fisheries in 1994 and which survived the major reform of the common fisheries policy in 2002, as well as two changes of title and consequent internal restructuring of the Commission's former Directorate-General for Fisheries to match the new circumstances as regards fisheries management at world level;

Finally, the Commission has checked that the 1994 restructuring plan has been substantially implemented with the result of turning Enichem into a viable undertaking.

As for possible non-compliance both with the restructuring plan covering the period 1998-2002 and with the many conditions imposed by the 1994 decision, if the Commission observes that a Member State is not complying with a conditional or negative decision applying to it, and in particular if there is abuse of the decision, then the Commission may, in accordance with the provisions of the procedural regulations relating to state aid , immediately contact the Court of Justice, and this in accordance with Article 88(2) of the Treaty establishing the European Community.

Lloyd Axworthy (Minister of Human Resources Development and Minister of Western Economic Diversification) moved: That the Standing Committee on Human Resources Development be directed to consult broadly, to analyze, and to make recommendations regarding the modernization and restructuring of Canada's social security system, with particular reference to the needs of families with children, youth and working age adults; That the Standing Committee's work be undertaken in two phases as follows: (i) an interim report by March 25, 1994 on Canadians' concerns and priorities regarding social security and training and preparations to receive the Government's Action Plan and proposed changes; and (ii) a final report by September 30, 1994, including a review of the Government's Action Plan and recommendations for reform (1105 ) He said: Mr. Speaker, in rising to speak to what I consider a very important motion I would like to begin by acknowledging and giving my appreciation to the deputy minister of my department and his staff.

On a proposal from Mr Marcelino Oreja, the Member of the Commission responsible for energy and transport, the Commission, on the basis of Decision No 3632/93/ECSC of 28 December 1993, today decided in favour of the 1994-1997 plan to modernize, rationalize and restructure the Spanish coal industry and to reduce its activities and authorized the granting of total aid of PTA 128 869 million to the Spanish coal industry for 1994. This aid consists of the following: - aid totalling PTA 105 780 million to cover operating losses by coal undertakings; - aid totalling PTA 14 715 million to cover exceptional social expenditure on behalf of workers who have lost their jobs following measures to restructure, rationalize, modernize, and reduce the activities of the Spanish coal industry; - aid totalling PTA 8 374 million to cover the technical costs of closing pits as a result of measures to restructure, rationalize, modernize and reduce the activities of the Spanish coal industry.
Sur proposition de Monsieur Marcelino Oreja, Commissaire à l'Energie et aux Transports, la Commission a, sur base de la décision no 3632/93/CECA du 28 décembre 1993, rendu aujourd'hui un avis favorable sur le plan de modernisation, de rationalisation et de restructuration et de réduction d'activité de l'industrie espagnole du charbon 1994-1997, et autorisé l'octroi d'aides à l'industrie houillère espagnole, au titre de l'exercice 1994, à concurrence de 128 869 millions de pesetas, qui se décomposent de la façon suivante: - une aide, à concurrence de 105 780 millions de PTA pour la couverture des pertes d'exploitation d'entreprises charbonnières; - une aide, à concurrence de 14 715 millions de PTA, destinée à couvrir les dépenses sociales exceptionnelles à verser aux travailleurs ayant perdu leur emploi suite aux mesures de restructuration, de rationalisation et de modernisation et de réduction d'activité de l'industrie houillère espagnole; - une aide, à concurrence de 8 374 millions de PTA, destinée à couvrir les coûts techniques de fermeture de sièges d'extraction résultant des mesures de restructuration, de rationalisation et de modernisation et de réduction de l'activité de l'industrie houillère espagnole.
