In order to promote the inclusiveness and relevance of the ATT process, the Council adopted Decision 2009/42/CFSP and Decision 2010/336/CFSP , which supported, inter alia, a series of regional seminars of worldwide coverage.

Considering the activities of Decision 2009/42/CFSP which expires in May 2010, the need to prepare for a successful UN Conference on the ATT in 2012, and the recommendation contained in resolution 64/48 to ensure the widest possible and effective participation in the Conference, the Union should support the preparatory process leading up to the UN Conference to ensure that it is as inclusive as possible and able to make concrete recommendations on the elements of a future ATT.
Compte tenu des activités prévues dans la décision 2009/42/PESC, qui expire en mai 2010, de la nécessité de préparer le succès de la Conférence des Nations unies sur le traité sur le commerce des armes en 2012, et de la recommandation figurant dans la résolution 64/48 visant à assurer une participation effective et la plus large possible à cette conférence, il convient que l’Union soutienne le processus préparatoire de la Conférence des Nations unies pour faire en sorte qu’il soit aussi ouvert que possible et qu’il permette de formuler des recommandations concrètes sur les éléments d’un futur traité.

Regrets that, despite the increasing importance of the CFSP in the role of the EU as a global player, the 2008 outturn for the CFSP amounts to EUR 289 million, representing only less than 4% of the outturn for the whole of Heading 4; points out that the adoption of the financial envelope for the CFSP and its breakdown across different budget lines are constrained by the provisions of point 42 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management (IIA), which, among other things, provides for a minimum amount in the event of disagreement between the two arms of the budgetary authority and prohibits entering appropriations in a reserve; reiterates, in this context, its concerns about the intergovernmental nature of this policy, which is governed by the Council’s decisions on the basis of its forecasts and financed by the EU budget;

Takes note, in particular, of Points 42 and 43 of the 2006 Interinstitutional Agreement, which concern the financing of the CFSP and provide for a structured dialogue between the Council and Parliament, and which could contribute to a genuine consultation with the Committee responsible if interpreted in a constructive and flexible way; to that end, regards the explanatory exchange of letters between the Finnish Presidency and the Chairmen of the two Committees involved as partially fulfilling the requirement that Parliament be consulted;

Recalls that European Union Special Representatives fall under the CFSP budget and that all the relevant provisions of Point 42 of the Interinstitutional Agreement also apply as regards the financial consequences of the extension of their mandates; is of the opinion that there is a need to establish criteria for the appointment and evaluation of EU Special Representatives, including the definition and purpose of their tasks, length of mandate, coordination and complementarity with the EC delegations under the first pillar and an assessment of their potential "added value"; calls on the Council and the Commission to cooperate in this respect, inter alia by providing timely access to the evaluation reports, which should include substantial, thorough and objective information and be drawn up under the responsibility of the High Representative;

As regards CFSP expenditure which is charged to the general budget of the European Communities in accordance with Article 28 of the Treaty on European Union, the institutions will endeavour, in the conciliation procedure provided for in Annex II, Part C, and on the basis of the preliminary draft budget established by the Commission, to secure agreement each year on the amount of the operating expenditure to be charged to the Community budget and on the distribution of this amount between the articles of the CFSP budget chapter suggested in the fourth paragraph of this Point.
42. Pour les dépenses de la PESC à la charge du budget général des Communautés européennes conformément à l'article 28 du traité sur l'Union européenne, les institutions s'efforceront de parvenir chaque année, dans le cadre de la procédure de concertation prévue à la partie C de l'annexe II et sur la base de l'avant-projet de budget établi par la Commission, à un accord sur le montant des dépenses opérationnelles à imputer au budget des Communautés et sur la répartition de ce montant entre les articles du chapitre "PESC" du budget suggérés au quatrième alinéa du présent point.
