The first subparagraph of Article 10(2) of Commission Regulation (EC) No 885/2006 of 21 June 2006 laying down detailed rules for the application of Council Regulation (EC) No 1290/2005 as regards the accreditation of paying agencies and other bodies and the clearance of the accounts of the EAGF and of the EAFRD (3) lays down that the amounts that are recoverable from, or payable to, each Member State, in accordance with the accounts clearance decision referred to in the first subparagraph of Article 10(1) of the said Regulation, shall be determined by deducting the monthly payments in respect of the financial year in question, i.e. 2010, from expenditure recognised for that year in accordance with paragraph 1.

Firstly the accounts of paying agencies are checked for accuracy by certification bodies in the Member States and are then subjected to an annual financial clearance decision by the Commission.

In accordance with the first subparagraph of Article 7(1) of Regulation (EC) No 1663/95, the accounts clearance decision referred to in Article 7(3) of Regulation (EC) No 1258/1999 determines, without prejudice to decisions taken subsequently in accordance with Article 7(4) of the Regulation, the amount of expenditure effected in each Member State during the financial year in question recognised as being chargeable to the EAGGF Guarantee Section, on the basis of the accounts referred to in Article 6(1)(b) of Regulation (EC) No 1258/1999 and the reductions and suspensions of advances for the financial year concerned, including the reductions referred to in the second subparagraph of Article 4(3) of Regulation (EC) No 296/96.

These charges which for the 1991 clearance total 5% of expenditure can be a substantial shock : 1518 mio ecu is to be recovered under the Commission's decision taken on 20 December 1994 regarding clearance of the 1991 accounts of the Guarantee fund.

Commenting on this first clearance of accounts decision of the Santer Commission, Mr Franz FISCHLER, the Commissioner of Agriculture and Rural Development, said that the Clearance of Accounts is an essential instrument of control of the application of the Common Agricultural Policy in the Member States, to whom the responsibility for the application of all the measures financed by the EAGGF-Guarantee has devolved.
