(4) When a person who is a contributor or survivor has become entitled under this Part to an annuity or annual allowance the amount of which would be less than two per cent of the Year’s Maximum Pensionable Earnings within the meaning of subsection 11(3) in respect of the year in which the request is made, there may be paid to that person, on request by that person, to the Minister in writing within three months from the day on which written notice is sent by the Minister informing the person of the amount of the annuity or annual allowance, an amount determined in accordance with the regulations to be the capitalized value of the annuity or annual allowance, which payment shall be in lieu of any other benefit under this Part and Part III.

11. When by these Regulations the widow of a contributor is entitled to an annual allowance herein specified, payment of the allowance shall be suspended in the event of her remarriage but shall be resumed in the event of the death of her husband by that marriage, but, in lieu of any further claim to payment of the allowance, an amount equal to the return of contributions less the total amount of the payments made to the contributor or to his widow under these Regulations may be paid to the widow, upon request by her to the Minister in writing, at any time before the death of her husband by that marriage.
11. (3) Notwithstanding anything in this section, where a participant who has been absent from duty with leave and has returned to duty is paying the appropriate amount of contributions in respect of a period when he was so absent by reservation from his pay and allowances, he may pay, in one lump sum, at any time prior to the expiration of the period during which the contributions are to be recovered from pay and allowances, the amount payable by him in respect of the period during which he was so absent.

Notes with concern that in order to cover higher school fees, the Agency grants staff whose children attend primary or secondary school a top-up allowance, which amounted to some EUR 389 000 in 2012, in addition to the education allowances provided for in the Staff Regulations of Officials of the European Communities ("the Staff Regulations"); notes that these allowances are not covered by the Staff Regulations and are, therefore, considered irregular by the Court of Auditors; acknowledges, however, that this situation is due to the lack of European Schools in the city the Agency is based in and that the purpose of these top-ups is to ensure equal treatment of the Agency’s employees under the Staff Regulations;
