The Minister is not liable to pay any amount under section 3 with respect to any loan made after June 28, 1983 if the lender has failed to comply with any regulation made pursuant to this Act respecting the registration of the loan, the making of reports in respect of the loan or the procedure to be followed in making a claim for loss in respect of the loan and, where the Minister decides not to pay, the Minister shall so notify the lender by notice in writing to the lender’s head office.
