1. Instruments and apparatus intended for medical research, establishing medical diagnoses or carrying out medical treatment which are donated either by a charitable or philanthropic organisation or by a private individual to health authorities, hospital departments or medical research institutions approved by the competent authorities of the Member States to receive such articles duty free, or which are purchased by such health authorities, hospitals or medical research institutions entirely with funds supplied by a charitable or philanthropic organisation or with voluntary contributions, shall be admitted free of import duties, always provided that it is established that:

(24) Care should be taken to avoid affecting some specific rules in the field of employee information and consultation existing in some national laws, addressed to undertakings or establishments which pursue political, professional, organisational, religious, charitable, educational, scientific or artistic aims, as well as aims involving information and the expression of opinions.
(24) Il convient de ne pas porter atteinte à certaines règles spécifiques dans le domaine de l'information et de la consultation des travailleurs qui existent dans certains droits nationaux et qui s'adressent aux entreprises ou aux établissements poursuivant des fins politiques, d'organisation professionnelle, confessionnelles, charitables, éducatives, scientifiques ou artistiques, ainsi que des fins d'information ou d'expression d'opinions.

2. In conformity with the principles and objectives of this Directive, Member States may lay down particular provisions applicable to undertakings or establishments which pursue directly and essentially political, professional organisational, religious, charitable, educational, scientific or artistic aims, as well as aims involving information and the expression of opinions, on condition that, at the date of entry into force of this Directive, provisions of that nature already exist in national legislation.
2. Dans le respect des principes et objectifs visés dans la présente directive, les États membres peuvent prévoir des dispositions spécifiques applicables aux entreprises ou aux établissements qui poursuivent directement et essentiellement des fins politiques, d'organisation professionnelle, confessionnelles, charitables, éducatives, scientifiques ou artistiques, ainsi que des fins d'information ou d'expression d'opinions, à condition que, à la date d'entrée en vigueur de la présente directive, des dispositions de ce type existent déjà en droit national.

The Conference stresses the importance, in pursuing the objectives of Article 117 of the Treaty establishing the European Community, of cooperation between the latter and charitable associations and foundations as institutions responsible for social welfare establishments and services.
