Where a Community institution or body receives a request for access to environmental information and where this information is not held by that Community institution or body, it shall, as promptly as possible, but within 15 working days at the latest, inform the applicant of the Community institution or body or the public authority within the meaning of Directive 2003/4/EC to which it believes it is possible to apply for the information requested or transfer the request to the relevant Community institution or body or the public authority and inform the applicant accordingly.

Community institutions and bodies would take into account the outcome of the public participation in taking a decision on a plan or programme relating to the environment and inform the public about it; databases or registers should include information on steps taken in proceedings for infringement of Community law; a delay of 15 working days for an answer from the Community institutions or bodies to a request for access to information would be established; Community institutions and bodies have to interpret any grounds for refusing access to information in a restrictive way, taking into account the public interest served by disclosure and whether the information relates to emissions into the environment; extension to eight weeks of the delay to receive comments from the public to plans and programmes; extension to six weeks of the delay for any non-governmental organisation to present a request for the review of a Community act; the regulation would be applicable 9 month after its entry into force.

1. The Staff Regulations of officials of the European Communities and the Conditions of Employment of other servants of the European Communities laid down in Regulation (EEC, ECSC, Euratom) No 259/68 and the rules adopted jointly by the European Community institutions for the purpose of applying these Staff Regulations and Conditions of Employment shall apply to the staff of the Institute.

The overall objectives of the Institute shall be to contribute to and strengthen the promotion of gender equality, including gender mainstreaming in all Community policies and the resulting national policies, and the fight against discrimination based on sex, and to raise EU citizens' awareness of gender equality by providing technical assistance to the Community institutions, in particular the Commission, and the authorities of the Member States, as set out in Article 3.

Since the objectives of this Regulation, namely to contribute to and strengthen the promotion of gender equality, including gender mainstreaming in all Community policies and the resulting national policies, and the fight against discrimination based on sex, and to raise EU citizens' awareness of gender equality by providing technical assistance to the Community institutions and the authorities of the Member States, cannot be sufficiently achieved by the Member States and can therefore, by reason of the scale of the action, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.

With regard to the rules governing liability which the Community may incur even in the absence of unlawful action by its institutions, the Court states that where, as here, it cannot be established that the conduct of the defendant institutions (the Council and the Commission) is unlawful, undertakings which bear a disproportionate part of the burden resulting from the Community institutions’ conduct may, under certain conditions, obtain compensation for the damage to them.
