As an alternative to paragraphs 1, 2 and 3 Member States may opt to take measures to ensure the provision of advice to users on the replacement of air-conditioning systems or on other modifications to the air-conditioning system which may include inspections to assess the efficiency and appropriate size of the air-conditioning system.

In order to ensure that the prohibition of certain fluorinated greenhouse gases is effective, there is a need to limit the possibility of retrofitting motor vehicles with air-conditioning systems designed to contain fluorinated greenhouse gases with a global warming potential higher than 150 and to prohibit filling air-conditioning systems with such gases.

In order to limit the emissions of certain fluorinated greenhouse gases from air conditioning systems in motor vehicles it is necessary to establish limit values for leakage rates and the test procedure for the assessment of leakage in air conditioning systems designed to contain fluorinated greenhouse gases with a global warming potential higher than 150 which are fitted to motor vehicles.
Afin de limiter les émissions de certains gaz à effet de serre fluorés provenant des systèmes de climatisation des véhicules à moteur, il est nécessaire d'arrêter des taux de fuite maximaux et une procédure d'essai pour mesurer les fuites que présentent les systèmes de climatisation conçus pour contenir des gaz à effet de serre fluorés dont le potentiel de réchauffement planétaire est supérieur à 150 et qui sont installés dans des véhicules à moteur.

Since the objectives of this Directive, namely to control the leakage of the specific fluorinated greenhouse gases in the air-conditioning systems fitted to vehicles and to prohibit from a certain date air-conditioning systems designed to contain fluorinated greenhouse gases with a global warming potential higher than 150, cannot be sufficiently achieved by the Member States acting alone and can therefore, by reason of the scale and effects of this Directive, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
Étant donné que les objectifs de la présente directive, à savoir le contrôle des fuites de gaz à effet de serre fluorés que présentent les systèmes de climatisation installés dans les véhicules et l'interdiction, à compter d'une certaine date, des systèmes de climatisation conçus pour contenir des gaz à effet de serre fluorés dont le potentiel de réchauffement planétaire est supérieur à 150, ne peuvent pas être réalisés de manière suffisante par les États membres agissant individuellement et peuvent donc, en raison des dimensions et des effets de la présente directive, être mieux réalisés au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité.
