The European Group for Private International Law suggested Article 4 (3) should contain a specific rule on short-term holiday tenancy, along the lines of the second subparagraph of Article 22 of the Brussels I Regulation. The wording could be the following: "However, contracts which have as their object tenancies of immovable property concluded for a temporary private use for a maximum period of six consecutive months will be governed by the laws of the country in which the lessor is domiciled, provided that the tenant is a natural person and that the landlord and the tenant are domiciled in the same country".

Second, the rules for disclaimer of commercial tenancy agreements in BIA proposal proceedings — section 65.2, a current provision — are different from the rules of disclaimer of other contracts, which are contained in the new BIA, section 65.11.

5. Notwithstanding paragraphs 1 to 4, a contract the subject matter of which is a right in rem in immovable property or a tenancy of immovable property shall be subject to the requirements of form of the law of the country where the property is situated if by that law:

Notwithstanding paragraphs -1 to 3 of this Article, a contract the subject matter of which is a right in rem in immovable property or a tenancy of immovable property shall be subject to the requirements of form of the law of the country where the property is situated if by that law those requirements are imposed irrespective of the country where the contract is concluded and irrespective of the law governing the contract, and cannot be derogated from by agreement.
