1. Where the UN Security Council or the Sanctions Committee lists a natural or legal person, entity or body and has provided a statement of reasons for the designation, the Council shall include that natural or legal person, entity or body in Annex I. The Council shall communicate its decision and the statement of reasons to the natural or legal person, entity or body concerned, either directly, if the address is known, or through the publication of a notice, providing that natural or legal person, entity or body with an opportunity to present observations.

Lorsque le Conseil de sécurité des Nations unies ou le comité des sanctions inscrit sur la liste une personne physique ou morale, une entité ou un organisme et a fourni un exposé des motifs pour la désignation, le Conseil inclut ladite personne physique ou morale, ladite entité ou ledit organisme sur la liste figurant à l'annexe I. (a) members of the legislature of a province or persons on the staff of such members; (b) employees of the government of a province; (c) members of a council or other statutory body charged with the administration of the civil or municipal affairs of a city, town, municipality or district, persons on the staff of such members or officers or employees of a city, town, municipality or district; (d) members of the council of a band as defined in subsection 2(1) of the Indian Act or of the council of an Indian band established by an Act of Parliament, persons on their staff or employees of such a council; (d.1) members of a governing body under the constitution of a first nation named in Schedule II to the Yukon First Nations Self-Government Act, persons on their staff or employees of such a governing body; (d.2) members of Nisga'a Government, as defined in the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act, persons on the staff of those members or employees of the Nisga'a Nation, a Nisga'a Village or a Nisga'a Institution, as defined in that Agreement; (e) diplomatic agents, consular officers or official representatives in Canada of a foreign government; or (f) officials of a specialized agency of the United Nations in Canada or officials of any other international organization to whom there are granted, by or under any Act of Parliament, privileges and immunities.

Council Regulation (EU) No 269/2014 (2) gives effect to certain measures provided for in Decision 2014/145/CFSP and provides for the freezing of funds and economic resources of natural persons responsible for, actively supporting or implementing, actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine, or stability or security in Ukraine or which obstruct the work of international organisations in Ukraine, and natural or legal persons, entities or bodies associated with them; legal persons, entities or bodies supporting, materially or financially, actions which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine; legal persons, entities or bodies in Crimea or Sevastopol whose ownership has been transferred contrary to Ukrainian law, or legal persons, entities or bodies which have benefitted from such a transfer; or natural or legal persons, entities or bodies actively supporting, materially or financially, or benefitting from, Russian decision-makers responsible for the annexation of Crimea or the destabilisation of Eastern Ukraine.

By way of derogation from Article 2 and provided that a payment by a natural or legal person, entity or body listed in Annex I is due under a contract or agreement that was concluded by, or an obligation that arose for the natural or legal person, entity or body concerned, before the date on which that natural or legal person, entity or body had been designated by the UN Security Council or the Sanctions Committee, the competent authorities of the Member States may authorise, under such conditions as they deem appropriate, the release of certain frozen funds or economic resources, provided that the competent authority concerned has determined that:

“federal institutions” includes any of the following institutions of the Parliament or Government of Canada: (a) the Senate, (b) the House of Commons, (c) the Library of Parliament, (c.1) the office of the Senate Ethics Officer and the office of the Conflict of Interest and Ethics Commissioner, (d) any federal court, (e) any board, commission or council, or other body or office, established to perform a governmental functions by or pursuant to an Act of Parliament or by or under the authority of the Governor in Council, (f) a department of the Government of Canada, (g) a Crown corporation established by or pursuant to an Act of Parliament, and (h) any other body that is specified by an Act of Parliament to be an agent of Her Majesty in right of Canada or to be subject to the direction of the Governor in Council or a minister of the Crown, but does not include (i) any institution of the Council or government of the Northwest Territories or of the Legislative Assembly or government of Yukon or Nunavut, or (j) any Indian band, band council or other body established to perform a governmental function in relation to an Indian band or other group of aboriginal people [.]

(3.2) The Governor in Council or the lieutenant governor in council of a province, as the case may be, may designate a person or body as a public authority for the purposes of subsection (3.1), and that designation is conclusive evidence that the person or body is a public authority described in that subsection”.
