(2) Where a cheque is presented for payment that does not at the time of prese
ntment appear to be crossed, or to have had a crossing that has been obliterated, or to have been added to or altered otherwise than as authorized by this Act, the bank paying the cheque in good faith and without negligence shall not be respo
nsible or incur any liability, nor shall the payment be questioned by reason of the cheque having been crossed, or of the crossing having been obliterated or having been added to or altered otherwise than as authorized b
...[+++]y this Act, and of payment having been made otherwise than to a bank or to the bank to which the cheque is or was crossed, or to the bank acting as its agent for collection, as the case may be.
(2) La banque qui paie, de bonne foi et sans négligence, un chèque ne paraissant pas, lors de sa présentation au paiement, être barré ni marqué d’un barrement altéré d’une manière non conforme à la présente loi, notamment par oblitération ou addition, n’encourt aucune responsabilité par suite du paiement, la validité du paiement ne pouvant être contestée à cause du barrement ou de l’altération de celui-ci, ni à cause du fait que le chèque a été payé autrement qu’à la banque au nom de laquelle il est barré ou à la banque servant d’encaisseur pour celle-ci.
