Of course, the European people have not paid all that much attention to the wording of the declaration or to how much work went into putting together these two short pages, in which there is not in fact anything particularly extraordinary or original.

On the second aspect, it should be noted that, as the honourable Member points out, the granting of nationality of a Member State is a matter of national jurisdiction (see Declaration 2 on nationality of a Member State, annexed to the Final Act of the Conference of the Representatives of the Governments of the Member States establishing the Treaty on European Union, OJ 1992, C 191, page 98). Nonetheless, exercise of this jurisdiction must comply with Community law (see: Judgement of the Court of Justice of 7 July 1992 in case C-369/90, Micheletti, European Court Reports 1992 page I-4239, item 10: “Under international law, it is for each Member State, having due regard to Community law, to lay down the conditions for the acquisition and loss of nationality”. )

Mr. Brent St. Denis (Algoma, Lib) moved: Motion No. 27 That Bill C-68, in Clause 12, be amended (a) by replacing lines 44 to 45, on page 13, with the following: ``1977 if the particular individual is the spouse or a brother, sister, child or descendent of an''; and (b) by adding after line 2, on page 14, the following: ``(7.1) Where the particular handgun referred to in subsection (6) was manufactured between 1945 and 1977, the particular individual referred to in subsection (7) is only eligible for the licence if the individual submits, with the application for the licence, a statutory declaration declaring the handgun to be a family heirloom and stating the reasons for that belief'.

Brent St. Denis (Algoma, Lib) propose: Motion no 27 Qu'on modifie le projet de loi C-68, à l'article 12 a) par substitution, aux lignes 38 à 40, page 13, de ce qui suit: «paragraphe (6) et fabriquée avant 1977, le particulier qui est le conjoint, le frère, la soeur, l'enfant ou le descendant d'un particulier qui» b) par adjonction, après la ligne 43, page 13, ce qui suit: «(7.1) Lorsque l'arme de poing visée au paragraphe (6) a été fabriquée entre 1945 et 1977, il peut être délivré un permis de possession d'arme à feu au particulier visé au paragraphe (7) pourvu que celui-ci présente, avec la demande, une déclaration sous serment attestant que l'arme de poing est un héritage familial et énonçant les motifs qu'il a de croire que tel est le cas».
