Paragraph 1 shall not apply to the leasing, chartering or provision of crew services, provided that the relevant Member State has notified the Sanctions Committee in advance on a case-by-case basis and has provided the Sanctions Committee with the information demonstrating that such activities are exclusively for livelihood purposes which will not be used by DPRK persons or entities to generate revenue, as well as information on measures taken to prevent such activities from contributing to violations of the provisions of UNSCR 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013) or 2270 (2016).

35. Notwithstanding paragraph (a) of the definition “entity charter” in section 2 and subparagraph 34(c)(i), the issue of a program permit or the deemed issuance of a small carrier charter permit by the Agency to an air carrier to operate an entity charter originating in Canada for the transportation of live cattle, equines, swine, sheep, goats and poultry is not subject to the condition that the cost of transportation be paid solely by the charterer if there is only one charterer per flight.
35. Malgré l’alinéa a) de la définition de « vol affrété sans participation » à l’article 2 et le sous-alinéa 34c)(i), la délivrance par l’Office d’un permis-programme — ou la délivrance présumée d’un permis d’affrètement de petit transporteur — au transporteur aérien pour un vol affrété sans participation en provenance du Canada servant au transport de bovins, d’équidés, de porcins, d’ovidés, de caprinés et de volailles vivants n’est pas subordonnée à la condition que le coût du transport soit payé uniquement par l’affréteur s’il n’y a qu’un seul affréteur par vol.

36.1 An air carrier that proposes to operate an entity charter with aircraft having an MCTOW of 35,000 pounds (15,900 kg) or less is deemed to have been issued a small carrier charter permit by the Agency for that purpose if the air carrier meets all the applicable requirements of the Act and these Regulations other than those that are solely in respect of an air carrier that proposes to operate an entity charter with aircraft having an MCTOW greater than 35,000 pounds (15,900 kg).
36.1 Le transporteur aérien qui se propose d’effectuer un vol affrété sans participation au moyen d’aéronefs ayant une MMHD d’au plus 35 000 livres (15 900 kg) est réputé avoir obtenu de l’Office à cette fin un permis d’affrètement de petit transporteur, s’il satisfait aux exigences applicables de la Loi et du présent règlement, à l’exception de celles visant exclusivement les transporteurs aériens qui se proposent d’effectuer un vol affrété sans participation au moyen d’aéronefs ayant une MMHD de plus de 35 000 livres (15 900 kg).

36 (1) Except as provided for in subsection (2), on receipt of an application that is made by a non-Canadian air carrier for a program permit to operate a fifth freedom entity charter and that satisfies the requirements of these Regulations, the Agency shall, by making particulars of the application available to all Canadian air carriers holding non-scheduled international licences valid for that entity charter, advise those carriers of the application.

33.2 An air carrier that proposes to operate an entity charter with aircraft having an MCTOW greater than 35,000 pounds (15,900 kg) shall apply in writing to the Agency for a program permit in respect of the entity charter in accordance with subsection 34(2).
