Vessels operating in short sea shipping shall be excluded from the arrangement referred to in point (b) of the first subparagraph. The arrangement referred to in point (a) of the first subparagraph shall continue to apply to them for a transitional period of five years.

In order to meet the exceptional circumstances of the transition to the decommitment rules introduced by this Regulation, appropriations which have been cancelled because of decommitments made by the Commission for the financial year 2007 in the implementation of the first subparagraph of Article 93(1) and of Article 97 of Regulation (EC) No 1083/2006, pursuant to Article 11 of the Financial Regulation, shall be reconstituted to the extent necessary for the implementation of the second subparagraph of Article 93(1) of Regulation (EC) No 1083/2006.

If, however, the Court of Justice finds that the decision of the Court of First Instance affects the unity or consistency of Community law, the Court of Justice will, in the cases provided for in Article 225(2) of the EC Treaty, refer the case back to the Court of First Instance, which will be bound by the points of law decided by the Court of Justice (first subparagraph of point 1 of paragraph 2 of Article 62c).
