The African, Caribbean and Pacific (ACP) States referred to in Protocol No 8 on ACP Sugar annexed to the Fourth ACP-EEC Convention, the Republic of Zambia and the European Community have agreed on the following.

3. In order to facilitate the transition to the new trading arrangements, the non-reciprocal trade preferences applied under the Fourth ACP-EC Convention shall be maintained during the preparatory period for all ACP countries, under the conditions defined in Annex V to this Agreement.
3. Afin de faciliter la transition vers les nouveaux accords commerciaux, les préférences commerciales non réciproques appliquées dans le cadre de la quatrième convention ACP-CE seront maintenues au cours de la période préparatoire pour tous les pays ACP, aux conditions définies à l'annexe V du présent accord.

Article 11(1)b of the Directive stipulates that the competent authorities of Member States shall not authorise shipments of radioactive waste to a State party to the Fourth ACP-EEC Convention which is not a member of the Community, taking account, however, of Article 14.

'The representatives of the ACP States referred to in Protocol 8 on ACP sugar annexed to the Fourth ACP-EEC Convention and of the Commission, acting on behalf of the European Community, have agreed, pursuant to the provisions of the said Protocol, on the following:
«Dans le cadre des négociations prévues à l'article 5 paragraphe 4 de l'accord entre la Communauté économique européenne et la république de l'Inde sur le sucre de canne, les représentants de l'Inde et de la Commission, agissant au nom de la Communauté européenne, sont convenus de ce qui suit.

Whereas procedures should be established for the implementation and administration of humanitarian aid financed by the European Community from the general budget, with emergency aid under the Fourth ACP-EC Convention signed at Lomé on 15 December 1989, amended by the Agreement amending the said Convention, signed at Mauritius on 4 November 1995 remaining subject to the procedures and arrangements laid down in that Convention,
considérant qu'il y a lieu de fixer les modalités d'exécution et de gestion de l'aide humanitaire de la Communauté financée par le budget général des Communautés européennes, les actions d'aide d'urgence prévues par la quatrième convention ACP-CE, signée à Lomé le 15 décembre 1989, modifiée par l'accord portant modification de ladite convention, signé à Maurice le 4 novembre 1995, restant régies par les procédures et les modalités établies par ladite convention,

Whereas Protocol 5 on bananas to the fourth ACP-EEC Convention provides that, in respect of its banana exports to the Community markets, no ACP State shall be placed, as regards access to its traditional markets and its advantages on those markets, in a less favourable situation that in the past or at present;
