They are always balancing in every case the right to make a full answer and defence, the privacy rights of the complainant and how high that threshold is in the particular documents; and, in almost all cases as well, the probative value of the document, what it will do for the proceeding, what information will it transmit and how will it help the trier of fact come to a decision.
