(4) For the purposes of paragraph 149(1)(o.3) of the Act, where a small business investment corporation holds an interest in a partnership or trust that qualified as a small business investment limited partnership or small business investment trust, as the case may be, when the interest was acquired and that, but for this subsection, would cease at a subsequent time to so qualify, the interest in the partnership or trust shall be deemed to be an interest in a small business investment limited partnership or small business investment trust, as the case may be, for the 24 months immediately following the subsequent time.

For the purposes of these Regulations, the making, holding or acquiring of an investment indirectly by an administrator on behalf of a PRPP, the holding, acquiring or owning of property indirectly by an administrator on behalf of a PRPP or the lending of money indirectly by an administrator on behalf of a PRPP includes the making, holding, acquiring, owning or lending of an investment, a property or money, as the case may be, by a mutual fund, a pooled fund, a segregated fund or a trust fund in which the funds of a member’s account have been invested.

Recalls that CSR is a concept whereby companies voluntarily incorporate social and environmental concerns into their business strategy; notes that the implementation of CSR practices can rebuild trust in business, which is vital for Europe's social market economy; notes, however, that the heterogeneity of the concept of CSR, whereby different companies have developed different standards regarding social accounting, auditing and reporting, raises the issue of comparability; acknowledges the efforts made by the EU to apply more general guidelines for the definition and use of CRS; points out, however, that the diversity and heterogeneity of the concept still remain; urges the EU to take concrete action in international fora to move CSR away from a purely voluntary approach and to identify clear legal obligations on corporations as regards human rights and CLS, along with effective ways to hold them accountable in the event of breaches; considers for instance that, when Member States are asked by multinational companies for investment guarantees, they should bind those guarantees to the implementation of the official CSR guidelines;

(a) has sound administrative and accounting procedures, control and safeguard arrangements for electronic data processing and adequate internal control mechanisms including, in particular, rules for personal transactions by its employees or for the holding or management of investments in financial instruments in order to invest own funds and ensuring, inter alia, that each transaction involving the fund may be reconstructed according to its origin, the parties to it, its nature, and the time and place at which it was effected and that the assets of the unit trusts/common funds or of the investment companies managed by the management company are invested according to the fund rules or the instruments of incorporation and the legal provisions in force.

Investment in the units of a unit trust managed by the same management company or by any other company with which the management company is linked by common management or control, or by a substantial direct or indirect holding, shall be permitted only in the case of a trust which, in accordance with its rules, has specialized in investment in a specific geographical area or economic sector, and provided that such investment is authorized by the competent authorities.
3.
