IN-CONTEXT TRANSLATIONS

First, action for annulment brought on the basis of Article 263 TFEU, Article 1(65)(b) and (67)(d) of Regulation (EU, Euratom) No 1023/2013 of the European Parliament and of the Council of 22 October 2013 amending the Staff Regulations of Officials of the European Union and the Conditions of Employment of Other Servants of the European Union (OJ 2013 L 287, p. 15), in that those provisions make the right to reimbursement of annual travel expenses and travelling time relating thereto conditional upon receipt of the expatriation or foreign residence allowance, and, secondly, claim for damages based on Article 340 TFEU, seeking compensation for material and non-material damage allegedly suffered by the applicant.
D’une part, demande d’annulation, introduite sur le fondement de l’article 263 TFUE, de l’article 1er, paragraphe 65, sous b), et paragraphe 67, sous d), du règlement (UE, Euratom) no 1023/2013 du Parlement européen et du Conseil, du 22 octobre 2013, modifiant le statut des fonctionnaires de l’Union européenne et le régime applicable aux autres agents de l’Union européenne (JO L 287, p. 15), en ce que ces dispositions lient le droit au remboursement des frais de voyage annuel et le délai de route pour ce voyage au bénéfice de l’indemnité de dépaysement ou d’expatriation, et, d’autre part, demande en indemnité fondée sur l’article 340 TFUE, visant à la réparation des préjudices matériel et moral prétendument subis par la requérante.

60. Welcomes the Council's Action Plan for strengthened EU action in Afghanistan and Pakistan, adopted at the October 2009 General Affairs and External Relations Council, and its declaration of its renewed readiness to assist in meeting the challenges of the region, in cooperation with the countries concerned and the international partners, but stresses that the Plan will remain just that unless there is a clear commitment from the EU Member States to contribute to its implementation; calls on the Council, the Commission and the Swedish Presidency to make a concerted effort to implement the Plan without delay and before the end of 2009; urges the Council to make more progress towards full deployment of staff in EUPOL in order to establish sustainable and effective civilian policing arrangements capable of enhancing the security environment;
60. se félicite du plan d'action du Conseil pour le renforcement de l'action de l'UE en Afghanistan et au Pakistan, adopté lors du Conseil Affaires générales et relations extérieures d'octobre 2009 et de sa déclaration par laquelle il réaffirme sa disponibilité pour apporter son soutien afin de relever les défis majeurs de la région, en coopération avec les pays concernés et les partenaires internationaux, mais souligne que le plan sera limité, à moins qu'il n'y ait un engagement clair de la part des États membres de l'Union européenne pour contribuer à sa mise en œuvre; invite le Conseil, la Commission et la présidence suédoise à faire un effort concerté afin de mettre ce plan en œuvre au plus vite, avant la fin de l'année 2009; exhorte le Conseil à faire des progrès rapides pour le déploiement total du personnel d'EUPOL en vue de créer des dispositifs de police civile durables et efficaces, susceptibles de renforcer la sécurité;

Other cuts were made by the Council on staff related items and in particular a reduction of EUR 279 000 in item 1204 (“Entitlement on entering and leaving the service and on transfer”), EUR 121 000 in item 1612 (“Further training for staff”) and also EUR 1.23 million in item 1406 (“other supplementary services (translation or interpretations”).

Concerning the Staff related demands of the other institutions, the Council accepted conversions and upgradings, in particular related to career development under the new Staff Regulations.
En ce qui concerne les demandes des autres institutions en matière de personnel, le Conseil a accepté les reconversions et les revalorisations, notamment au titre du développement de carrière prévu par le nouveau statut des fonctionnaires.

On 7 April 2008, by Decision 2008/298/CFSP (1) the Council amended Decision 2001/80/CFSP of 22 January 2001 on the establishment of the Military Staff of the European Union (2) to specify, inter alia, the tasks of the Military Staff of the European Union (EUMS) in relation to the EU Operations Centre.

[34] According to Parliament and Council Regulation (EC) No 1073/1999 and Council Regulation (Euratom) No 1074/1999 (OJ L 136, 31/5/1999, p. 1 and 8), the purpose of OLAF's investigations is fighting fraud, corruption and any other illegal activity affecting the financial interests of the European Community" and "investigating to that end serious matters relating to the discharge of professional duties such as to constitute a dereliction of the obligations of officials and other servants of the Communities liable to result in disciplinary or, as the case may be, criminal proceedings, or an equivalent failure to discharge obligations on the part of members .or members of the staff of institutions, bodies, offices or agencies not subject to the Staff Regulations ..".
[34] Selon le Règlement (CE) n° 1073/1999 du Parlement européen et du Conseil et le Règlement (Euratom) n° 1074/1999 du Conseil (JO L 136 du 31/5/1999, p. 1 et 8),les enquêtes menées par l'OLAF sont destinées à "lutter contre la fraude, la corruption et contre toute autre activité illégale portant atteinte aux intérêts financiers de la Communauté européenne" et à "y rechercher à cet effet les faits graves, liés à l'exercice d'activités professionnelles, pouvant constituer un manquement aux obligations des fonctionnaires et agents des Communautés, susceptible de poursuites disciplinaires et le cas échéant, pénales, ou un manquement aux obligations analogues des membres .ou des membres du personnel des institutions, organes et organismes non soumis au statut".
