(determined without reference to the existence of, or the amount of any interest paid or payable on, any other debt obligation), that amount shall, for the purposes of clause 18(9.2)(a)(iii)(A), subparagraph 18(9.2)(b)(i), paragraph 18(9.3)(b) and subsection 18(9.6), be deemed to be an amount of interest payable on the debt obligation by the borrower in respect of the subsequent period and not to be an amount of interest payable on the debt obligation by the borrower in respect of the particular period and shall, when paid, be deemed for the purposes of subparagraph 18(9.2)(a)(ii) and paragraph 18(9.3)(a) to be an amount paid in satisfaction of the obligation to pay interest on the debt obligation in respect of the subsequent period.

During the transitional period, Member States levying withholding tax may provide that an economic operator making an interest payment to, or securing such a payment for, an entity or a legal arrangement referred to in Article 4(2), which has its place of effective management in another Member State, shall be considered to be the paying agent in place of the entity or legal arrangement and shall levy the withholding tax on that interest, unless the entity or legal arrangement has formally agreed to its name if any, its legal form, its place of effective management and the total amount of interest paid to it or secured for it being communicated in accordance with the fourth subparagraph of Article 4(2)’.

Question No. 204 Mr. Brian Murphy: With respect to the National Do Not Call List (DNCL) that was created to reduce the number of unwanted telemarketing calls received by Canadians, as of March 4, 2010: (a) what is the total number of fines that have been imposed to date by the Canadian Radio-television and Telecommunications Commission (CRTC); (b) what is the total value of fines that have been imposed to date; (c) what is the total number of fines that have been paid to date; (d) what is the total value of fines that have been paid to date; (e) why, as a general policy, does the CRTC not release to the public the names of companies violating the National DNCL if the fine is paid without being contested; (f) why are CRTC hearings on the National DNCL violations not open to the Canadian public or to the media; and (g) has the CRTC forwarded information on violations of the National DNCL to the RCMP for further investigation?

5. During the transitional period, Member States levying withholding tax may provide that an economic operator paying interest to, or securing interest for, an entity referred to in Article 4(2) established in another Member State shall be considered the paying agent in place of the entity and shall levy the withholding tax on that interest, unless the entity has formally agreed to its name, address and the total amount of interest paid to it or secured for it being communicated in accordance with the last subparagraph of Article 4(2).
5. An economic operator paying interest to, or securing interest for, such an entity established in another Member State which is considered a paying agent under this paragraph shall communicate the name and address of the entity and the total amount of interest paid to, or secured for, the entity to the competent authority of its Member State of establishment, which shall pass this information on to the competent authority of the Member State where the entity is established.
Un opérateur économique payant des intérêts, ou attribuant le paiement d'intérêts, à une telle entité établie dans un autre État membre et considérée comme agent payeur en vertu du présent paragraphe communique la dénomination et l'adresse de l'entité ainsi que le montant total des intérêts payés ou attribués, à l'entité, à l'autorité compétente de l'État membre où il est établi; cette dernière transmet ensuite ces informations à l'autorité compétente de l'État membre où l'entité est établie.
