The Committee on Institutional Affairs therefore recommends to the European Parliament that it give strong support to the proposals submitted to the Intergovernmental Conference and draw attention at the same time to the fact that while the requisite Community legal acts could also be based on Article 138a in conjunction with Article 235 of the EC Treaty, there are strong arguments, in the interests of transparency, legal clarity and credibility in the eyes of the public, in favour of the proposals currently before the Intergovernmental Conference.

This is entirely logical: the Community's interests need to be protected in a Community context at regulatory and operational levels and at that of resources (databases, etc.). Neither the traditional horizontal intergovernmental cooperation, nor cooperation under the third pillar of the Maastricht Treaty (justice and home affairs) thus provides a suitable framework for such work.
