IN-CONTEXT TRANSLATIONS

8. Recognises that Paris Principles-aligned NHRIs are well placed to provide support for the implementation of the UN Guiding Principles and to facilitate, and even ensure, access to remedies; calls on the EU and its Member States to recognise NHRIs alongside enterprises and bodies representing employees, employers and consumers as key partners in advancing the human rights and business agenda, developing linkages between business, the state and civil society and promoting internationally recognised social, environmental and human rights standards and guidelines; calls, in this context, on the Member States to strengthen and, where necessary, broaden the mandates of the NHRIs to make them more effective, or, where no Paris Principles-aligned NHRI is in place, to take steps to establish one, and for the EU to develop appropriate strategic support; commits itself to establishing a regular annual exchange of views with NHRIs in the framework of the LIBE and/or DROI committees, building on the experience of the DROI committee’s exchange of views on the ‘EU and Eastern Partnership Ombudsmen 2011 Summit’, and to complement such exchanges with targeted workshops on human rights and business;
8. considère que les INDH appliquant les principes de Paris sont bien placées pour aider à l'application des principes directeurs des Nations unies et faciliter l'accès à des voies de recours, voire le garantir; demande à l'Union et aux États membres de reconnaître que les INDH, aux côtés des entreprises et des organismes représentant les travailleurs, les employeurs et les consommateurs, constituent des partenaires essentiels pour faire progresser la question des droits de l'homme et des entreprises, établir des liens entre les entreprises, les pouvoirs publics et la société civile et promouvoir des normes et orientations internationalement reconnues en matière sociale, environnementale et de droits de l'homme; dans ce contexte, demande aux États membres de renforcer et, au besoin, d'élargir le mandat des INDH afin qu'il ait davantage d'effet ou, en l'absence d'une INDH appliquant les principes de Paris, de prendre des mesures afin d'en établir une et invite l'Union à apporter à cet égard un soutien stratégique approprié; s'engage à instaurer un échange de vues annuel régulier avec des INDH dans le cadre des commissions LIBE et/ou DROI en s'appuyant sur les résultats de l'échange de vues de la commission DROI sur le sommet 2011 qui a réuni l'Union européenne et les médiateurs des pays participant au partenariat oriental et à compléter ces échanges par des ateliers ciblés sur les droits de l'homme et les entreprises;

Notes that, since the G20 Summit of 2 April 2009, offshore financial centres have committed to OECD standards on transparency and exchange of information; notes however that the harmful structures of tax havens still prevail; calls once more for action beyond the OECD framework to combat tax havens in view of their various shortcomings; in this respect, reiterates its concerns about the fact that the OECD international standards require exchange of information on request but that there is no automatic exchange of information along the lines of the Savings Tax Directive; likewise criticises the fact that the OECD allows governments to escape its blacklist merely by promising to adhere to the information exchange principles, without ensuring that these principles are effectively put into practice; considers also that the requirement to conclude agreements with 12 other countries in order to be removed from the backlist is arbitrary as it does not refer to any qualitative indicators for an objective assessment of compliance with good governance practices;
54. constate que, depuis la tenue du sommet du G20 le 2 avril 2009, les centres financiers extraterritoriaux (offshore) se sont engagés à respecter les normes de l'OCDE sur la transparence et l'échange de données; constate cependant que les structures dommageables des paradis fiscaux prédominent toujours; demande une fois de plus que des mesures soient prises, au-delà du cadre de l'OCDE, pour lutter contre les paradis fiscaux en raison de leurs diverses défaillances; réaffirme à cet égard ses préoccupations quant au fait que les normes internationales de l'OCDE supposent un échange d'informations à la demande, et non un échange automatique d'informations comme dans le cadre de la directive sur la fiscalité de l'épargne; critique également le fait que l'OCDE permet aux États d'éviter de se retrouver sur sa liste noire par la simple promesse de respecter les principes de l'échange d'informations, mais sans veiller à ce que ces principes soient effectivement mis en pratique; estime également que la conclusion d'accords avec 12 pays, qui permet à un État d'être retiré de la liste noire, est un critère arbitraire puisqu'il ne repose sur aucun indicateur qualitatif permettant une évaluation objective du respect des pratiques de bonne gouvernance;

Building on its experience with other Internal Market systems, such as the Internal Market Information Exchange system (IMI)[21] and the market surveillance information exchange system (ICSMS)[22], the Commission is currently analysing how a modern system could be designed to respond best to users’ needs by way of an interface for essential information to be shared and exchanged and how it could build on existing networks, such as for example IMI.
