The intrinsic link between radiation protection and nuclear safety was recognised by the European Court of Justice in its ruling in the Case C-29/99, according to which “ it is not appropriate, in order to define the Community’s competencies, to draw an artificial distinction between the protection of the health of the general public and the safety of sources of ionising radiation".
Le lien intrinsèque entre la radioprotection et la sûreté nucléaire a été reconnu par la Cour de justice des Communautés européennes dans son arrêt rendu dans l’affaire C-29/99 indiquant qu’il « ne convient pas d ’ opérer, pour délimiter les compétences de la Communauté, une distinction artificielle entre la protection sanitaire de la population et la sûreté des sources de radiations ionisantes ».
