Let me say that the centre generally supports the positions taken by the like-minded group and by leading non-governmental organizations on the important issues of scope of jurisdiction, state consent, complementarity, and the independence of the prosecutor.

(2) The Minister may enter into a reciprocal arrangement with the government of a foreign jurisdiction to enable a witness who is involved in activities of a law enforcement agency in that jurisdiction to be admitted to the Program, but no such person may be admitted to Canada pursuant to any such arrangement without the consent of the Minister of Citizenship and Immigration nor admitted to the Program without the consent of the Minister.

Stresses its serious concerns in relation to the work within the Council of Europe's Cybercrime Convention Committee on the interpretation of Article 32 of the Convention on Cybercrime of 23 November 2001 (Budapest Convention) on transborder access to stored computer data with consent or where publicly available, and opposes any conclusion of an additional protocol or guidance intended to broaden the scope of this provision beyond the current regime established by this Convention, which is already a major exception to the principle of territoriality because it could result in unfettered remote access by law enforcement authorities to servers and computers located in other jurisdictions without recourse to MLA agreements and other instruments of judicial cooperation put in place to guarantee the fundamental rights of the individual, including data protection and due process, and in particular Council of Europe Convention 108;

Stresses that cloud services that fall under third country jurisdiction should provide users located in the EU with a clear and distinguishable warning of the possibility that their personal data may be subject to intelligence and law enforcement surveillance by third country authorities under secret orders or injunctions, followed, where applicable, by a request for the data subject’s explicit consent for the processing of personal data;

So I have the honour of moving the following motion, seconded by the leader of our party, the member for Toronto—Danforth: That the motion of the Bloc be amended by deleting all the words after “That, in the opinion of the House” and substituting the following: in order to honour the commitment to limit the federal spending power in Quebec's exclusive areas of jurisdiction, given the unanimous recognition by this House of the Quebec nation and the longstanding consensus in Quebec in this regard, the government should, so as to implement co-operative and assymetrical federalism: (a) provide a systematic right to opt out, with full financial compensation and without condition, of all existing and future programs, whether co-funded or not, that intrude into the exclusive jurisdictions of Quebec; (b) eliminate all federal spending in the exclusive jurisdictions of Quebec once a specific agreement has been reached by mutual consent with the government of Quebec; (c) transfer, at the request of the Government of Quebec, equivalent fiscal room.
