Notes that limited attention has been paid to trade in services during the Doha Round since the WTO Ministerial Conference held in Hong Kong in 2005; is aware that some services, such as transport, communication and legal services, represent the backbone of trade between countries involved in global value chains which rely to a great degree on the liberalisation of such services; stresses, however, that the lack of progress in the liberalisation of services largely reflects the stalemate reached in the Doha Round, in particular as regards the agricultural sector, including the lack of progress in phasing out agricultural export subsidies;

This evidence consists of data, contained in the complaints and the subsequent submissions regarding registration but is also supported by information from the Union industry and public sources, concerning the key injury factors set out in Article 3(5) of the basic anti-dumping Regulation and Article 8(4) of the basic anti-subsidy Regulation.

Points out that China has established very considerable trade advantages for itself in relation to the EU through targeted state subsidies, using a great variety of legal constructs; urges China to bring its state subsidy programmes into line with relevant WTO law; further calls on the Commission to reform the anti-subsidy regulation in order for the EU to be able to respond effectively to the considerable challenges presented by China;

The condition set out in the second indent of paragraph 1 shall be considered as not being fulfilled where the undertaking invoice is found not to comply with the provisions of the Annex or found not to be authentic or where the Commission has withdrawn the acceptance of the undertaking pursuant to Article 8(9) of Regulation (EC) No 384/96 or Article 13(9) of the basic anti-subsidy Regulation in a Regulation or Decision which refers to (a) particular transaction(s) and declares the relevant undertaking invoice(s) as invalid.

All other findings concerning subsidies remain as established in the original investigation and set out in the provisional Regulation and the definitive Regulation.
