23. Deplores, in this context, that the review of the Athena mechanism, which was due to be carried out by the end of 2014, has produced only very limited results, such as the organisation of a form of pre-financing of certain costs to speed up deployment; regrets that the Council did not reach an agreement on the inclusion of funding for the cost of the strategic deployment of EU battlegroups in the list of common costs systematically borne by Athena, only adopting instead a renewable decision for a two-year period; calls on the next European Council on Defence to consider a further expansion of the common costs eligible under Athena, such as the automatic financing of expenditure on CSDP operational and mission deployment (infrastructure for the accommodation of forces, expenses relating to the establishment of points of entry for troops into theatres of operations and security stocks of food and fuel where necessary);

The Civil Service Tribunal moreover considered — in paragraph 38 of the judgment under appeal — that the fact that, in rejecting the complaint, the AECE, while upholding the decision not to renew the applicant’s contract, thus departed from the statement of reasons contained in the decision of 15 October 2010 and instead adopted other reasons, cannot, of itself, render the non-renewal decision illegal, since the whole point of the complaint procedure is to allow review by the AECE of the contested decision in the light of the grievances put forward by the complainant, where appropriate modifying the reasons serving to support its operative part.
Le Tribunal de la fonction publique a, par ailleurs, considéré – au point 38 de l’arrêt attaqué – que la circonstance que, dans le rejet de la réclamation, l’AHCC, tout en maintenant la décision de ne pas renouveler le contrat de la requérante, se soit ainsi écartée de la motivation contenue dans la décision du 15 octobre 2010 pour retenir d’autres motifs ne saurait, en elle-même, rendre la décision de non-renouvellement illégale, l’objectif de la procédure de réclamation étant précisément de permettre le réexamen par l’AHCC de l’acte attaqué au regard des griefs avancés par le réclamant, le cas échéant en modifiant les motifs servant de support à son dispositif.

The legal basis chosen for this proposal for a Council Decision to renew the Agreement concluded between the EC and India for a scientific and technological cooperation between the two parties to the 2002 Agreement is dual. First, the basic article of the EC Treaty making provision for international cooperation is Article 170. Second, cooperation between the EC and third countries of international organisations is governed by the provisions of Article 300, for both opening negotiations and for concluding the agreed text.

What we need now is common sense when it comes to meeting targets. Otherwise we will soon realise that the decision sharply to raise the share of renewable energy sources to one fifth of energy production was a hasty one and one that will one day be a threat to the environment through the overfelling of forests.

1. Calls on the Commission to present by the end of 2007 at the latest a proposal for a renewable energy legislative framework to be adopted by co-decision on the basis of Article 175(1) of the EC Treaty; stresses that this legislative framework should maintain existing legislation for the renewable electricity and biofuels sectors, but must be strengthened and improved and accompanied by ambitious legislation on increasing the share of renewable energy for heating and cooling; urges the Commission to propose a sectoral approach within the legislative framework, setting clear and realistic binding targets for the electricity, transport and heating and cooling sectors;
