Temporary staff members directly recruited by the executive agencies, as provided for in Article 18(1) of Regulation No 58/2003 laying down the statute for executive agencies to be entrusted with certain tasks in the management of Community programmes, may not be regarded as being in the service of the Commission, given that the agencies, despite the degree of control which the Commission has over the composition of their governing bodies and the performance of their tasks, have departments which are separate from those of the Commission.

It is therefore impossible to adopt an interpretation which departs from the conditions governing the optional internal procedure for amicable settlement contained in Article 41 of the EIB Staff Regulations, so as to convert it into a mandatory procedure.

Decisions to reassign officials in the interest of the service, taken on the basis of Article 7(1) of the Staff Regulations, have as their purpose the proper functioning of the service, even where they are justified by internal relationship difficulties, and therefore come within the broad discretion which the institutions have to organise their departments to suit the tasks entrusted to them and to assign the staff available to them in the light of such tasks, provided that such assignment conforms with the principle of assignment to an equivalent post.

2. Without prejudice to the audits carried out by the Court of Auditors in liaison with the competent national audit bodies or departments pursuant to Article 287 of the Treaty, or any inspection carried out pursuant to Article 322(1)(b) of the Treaty, officials and other staff of the Commission shall carry out on-the-spot checks, including sample checks on projects and other measures financed under the Programme in particular to check compliance with the objectives of the Programme and the eligibility of actions as set out in Article 2, 3 and 4 of this Regulation.

Sans préjudice des audits réalisés par la Cour des comptes en liaison avec les organismes ou services nationaux d'audit compétents, conformément à l'article 287 du traité, ou de toute inspection menée en vertu de l'article 322, paragraphe 1, point b), du traité, les fonctionnaires ou autres agents de la Commission effectuent des contrôles sur place, notamment par sondage, sur les projets et autres mesures financés au titre du programme, notamment afin de vérifier leur conformité avec les objectifs du programme et l'admissibilité des actions conformément aux dispositions des articles 2, 3 et 4 du présent règlement.

4. The administration departments of the institutions shall consult each other regularly concerning the application of these Staff Regulations.
4. L'application des dispositions du présent statut fait l'objet d'une consultation régulière entre les administrations des institutions.

The aim must be to preserve a set of rules and implementing arrangements which are in line with the Staff Regulations, so that OLAF can also recruit staff from Commission departments or other institutions, without undermining the exchanges linked to the mobility of permanent staff, a principle advocated by all the institutions.
L'objectif doit être de maintenir un ensemble de règles ou modalités d'application dans le plein respect du statut, afin de permettre à l'Office de recruter aussi le personnel provenant des services de la Commission ou des autres institutions, sans pour autant nuire aux échanges liés à la mobilité du personnel permanent, principe par ailleurs prôné par toutes les institutions.

Whereas, in its judgment of 14 December 1995 in Case T-285/94, the Court of First Instance found that Article 3 of the said Regulation was unlawful because it conflicted with the second and third subparagraphs of Article 82(1) of the Staff Regulations from which it could not depart by virtue of the principle of the hierarchy of norms;
