3. Acting in the spirit of partnership and cooperation and in the light of the provisions of Article 40, the Government of the Republic of Tajikistan shall inform the Community of its intentions to submit new legislation or adopt new regulations which may render the conditions for the establishment or operation in the Republic of Tajikistan of subsidiaries and branches of Community companies more restrictive than the situation existing on the day preceding the date of signature of the Agreement.

However, in the framework of discussions and negotiations of the different proposals, the relevant provisions are revisited in the light of the new circumstances, such as in the case of the Directive on the qualification as refugee or as a person in need of subsidiary protection.

considérant que certains États membres n'autorisent les établissements de crédit à devenir membres de leurs marchés réglementés qu'indirectement, en créant une filiale spécialisée; que la possibilité donnée par la présente directive aux établissements de crédit de devenir directement membres des marchés réglementés sans avoir à créer de filiale spécialisée constitue, pour ces États membres, une réforme importante dont toutes les conséquences méritent d'être réévaluées au vu du développement des marchés financiers; que, compte tenu de ces éléments, le rapport que la Commission adressera au Conseil sur ce sujet au plus tard le 31 décembre 1998 devra prendre en compte tous les facteurs permettant à celui-ci d'apprécier de nouveau pour ces États membres les conséquences, et notamment les risques de conflits d'intérêts et le degré de protection de l'investisseur;
