Recalls that the Member States are responsible for more than one third of global arms exports; urges the Member States to comply not only with the eight criteria of Common Position 2008/944/CFSP (the EU Code of Conduct on Arms Exports) but also with EU development policy principles; calls for the competence on the rules governing arms exports to be transferred to the EU; reminds the Member States that developing countries should first and foremost invest financial resources in sustainable social and economic development, democracy, human rights and the rule of law; urges the VP/HR and the Member States to use the ongoing review of EU Common Position 2008/944/CFSP to strengthen the implementation and monitoring of EU criteria for arms exports; deeply regrets the failure of the UN negotiations for a global Arms Trade Treaty (ATT) in July 2012; calls on the VP/HR and the Member States to bring pressure to bear, as a matter of urgency, on those countries which opposed a robust global ATT; calls for a strong and robust ATT which requires state parties to deny any arms and ammunition export in case there is a serious risk that the arms would be used to commit or facilitate serious violations of international human rights law and international human rights, including genocide, crimes against humanity and war crimes;

(9) This Directive should be understood as having borrowed, where appropriate, the terminology used by several existing directives, namely Council Directive 67/548/EEC of 27 June 1967 on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances(4), Council Directive 70/156/EEC of 6 February 1970 on the approximation of the laws of the Member States relating to the type-approval of motor vehicles and their trailers(5), and Council Directive 75/442/EEC of 15 July 1975 on waste(6).

The Commission worked on this criminal law initiative, you might say, in full awareness of the facts, for we had carried out major preparatory work, in particular studying the definitions in each Member State, the penalties that can be applied under the law and – of no less importance – the specific ways in which penalties for drug trafficking are applied in each of the 15 Member States.

Support for activities in the area of asylum will cover: promoting the establishment and operation of the common European asylum system, leading to a common asylum procedure and a uniform status; facilitating the determination of the state responsible for examining an asylum application; support for the approximation of rules on recognition and content of protection status; promoting the efficiency and fairness of the asylum procedure and increasing convergence in decisions; developing resettlement programmes, entry facilities and legal means for admission into Member States on humanitarian grounds.
