If the third party that holds financial instruments belonging to an investor in relation to investment business or the depositary or third party to whom the assets of the UCITS have been entrusted are is located in a third country in which the judiciary system does not allow the investor-compensation scheme to subrogate to the rights of the investment firm or the UCITS , Member States shall ensure that the investment firm or the UCITS return to the investor-compensation scheme amounts equal to any payments it receives in the liquidation proceedings.“. The common standards concerned are in particular Council Directive 2001/40/EC of 28 May 2001 on the mutual recognition of decisions on the expulsion of third-country nationals (5) and its corollary, Council Decision 2004/191/EC of 23 February 2004 setting out the criteria and practical arrangements for the compensation of the financial imbalances resulting from the application of Directive 2001/40/EC on the mutual recognition of decisions on expulsion of third-country nationals (6), and Council Decision 2004/573/EC of 29 April 2004 on the organisation of joint flights for removals from the territory of two or more Member States, of third-country nationals who are subjects of individual removal orders (7).

Possible measures to encourage “win-win” situations, and/or to compensate for negative situations which may arise, could be: to provide up-to-date information on the conditions of entry and residence in the EU; to establish recruitment and training centres in the countries of origin for skills which are needed at EU level, and for cultural and language training; to create databases per skill/occupation/sector (portfolio of competences) of potential migrants; to facilitate the transfer of remittances; to compensate third countries for the educational costs of migrants leaving for the EU.

Calls on the Commission to examine whether it needs to put in place further measures by means of which EU citizens who are the victims of offences such as those defined in paragraph 18 will also benefit from compensation measures when the crimes were committed on the territory of third countries and the third country itself does not provide compensation;
