Annex Ia to the ACP-EC Partnership Agreement concerning the multiannual financial framework of cooperation under the ACP-EC Partnership Agreement for the period after the Ninth European Development Fund (EDF) states that the European Union shall maintain its aid effort to ACP States under the ACP-EC Partnership Agreement at least at the same level as that of the Ninth EDF, also adding the effects of inflation, growth within the EU and enlargement to 10 new Member States in 2004, but does not specify the exact period covered (five or six years), the amount or the financing instrument (general budget or new EDF).

The ACP side refused the interpretation of the Commission and the inclusion of sexual orientation into the scope of Article 8.4 and, on 28 September 2010, issued the 'Declaration of the 21st Session of the ACP Parliamentary Assembly on the Peaceful Co-existence of Religions and the Importance Given to the Phenomenon of Homosexuality in the ACP-EU Partnership', in which it asks for "due respect for the cultural differences and social diversity of the two Parties";
