On 20 May 2008, the European Court of Justice annulled Council Decision 2004/833/CFSP of 2 December 2004 implementing Joint Action 2002/589/CFSP with a view to a EU contribution to ECOWAS in the framework of the Moratorium on Small Arms and Light Weapons (hereinafter ‘the ECOWAS case’).[2] The Court found that measures against the proliferation of small arms and light weapons may be implemented by the Community under its development policy.

Le 20 mai 2008, la Cour de justice des Communautés européennes a annulé la décision 2004/833/PESC du Conseil du 2 décembre 2004 mettant en œuvre l'action commune 2002/589/PESC en vue d'une contribution de l'Union européenne à la CEDEAO dans le cadre du moratoire sur les armes légères et de petit calibre (ci-après «l’affaire CEDEAO»)[2]. La Cour a estimé que les mesures de lutte contre la prolifération des armes légères et de petit calibre pouvaient être mises en œuvre par la Communauté dans le cadre de sa politique de développement.

The Action Plan which was, inter alia, called for by a Resolution on entry into force of the Statute of the International Criminal Court approved by the European Parliament on 28 February 2002 to follow up Council Common Position 2001/443/CFSP of 11 June 2001 on the International Criminal Court was adopted on 4 February 2004 and should be adapted as appropriate.
Le plan d'action demandé, entre autres, par une résolution sur l'entrée en vigueur du statut de la Cour pénale internationale approuvée par le Parlement européen le 28 février 2002 pour assurer le suivi de la position commune 2001/443/PESC du Conseil du 11 juin 2001 concernant la Cour pénale internationale , a été adopté le 4 février 2004 et devrait le cas échéant être adapté.
