1. Applications for the EU Ecolabel for products falling within the product group ‘televisions’ submitted before the date of adoption of this Decision shall be evaluated in accordance with the conditions laid down in the version of Decision 2009/300/EC in force on the day immediately preceding the date of adoption of this Decision (‘the old version of Decision 2009/300/EC’).

C. whereas the Commission, despite the adoption on 1 December 2015 of a motion for a resolution by Parliament’s Committee on the Environment, Public Health and Food Safety in which it objected to the draft implementing decision authorising the placing on the market of products containing, consisting of, or produced from genetically modified maize NK603 × T25 (MON-ØØ6Ø3-6 × ACS-ZMØØ3-2), decided to disrespect the principle of sincere cooperation between EU institutions by adopting the implementing decision on 4 December 2015, which was 10 days before the opening of the first plenary sitting of Parliament where Parliament could vote on the motion for a resolution following its adoption in committee;
C. considérant que la Commission, en dépit de l'adoption, le 1 décembre 2015, d'une proposition de résolution de la commission de l'environnement, de la santé publique et de la sécurité alimentaire dans laquelle elle s'opposait au projet de décision d'exécution autorisant la mise sur le marché de produits contenant du maïs génétiquement modifié NK603 × T25 (MON-ØØ6Ø3-6 × ACS-ZMØØ3-2), consistant en ce maïs ou produits à partir de celui-ci, a décidé d'ignorer le principe de coopération loyale entre les institutions de l'Union en adoptant la décision d'exécution le 4 décembre 2015, 10 jours avant l'ouverture de la première séance plénière durant laquelle le Parlement pouvait voter sur la proposition de résolution à la suite de son adoption en commission;

Furthermore, the changes to the Treaties occurred after the adoption of Council Decision 97/836/EC, in particular the adoption of the Treaty on the Functioning of the European Union, have substantially altered the decision making procedure to be followed for the establishment of the position of the Union when voting Regulations to be adopted by the UNECE and the conclusion of agreements between the Union and international organisations, making it necessary to adapt those Decisions to the new procedures.

In consequence, having regard too to the fundamental importance that must attach, as indicated in paragraphs 64 and 65 above, to observance of the rights of the defence in the procedure preceding the adoption of a decision such as the contested decision, the General Court did not err in law in holding, at paragraphs 39 and 43 of the judgment under appeal, that the Council had not established that the contested decision had so urgently to be adopted that it was impossible for that institution to notify the PMOI of the new evidence adduced against it and to allow the PMOI to be heard before the contested decision was adopted.

To that end, this Commission Decision will also constitute the financing decision for the operational programmes of Belgium, Ireland, Malta, Poland, Slovenia, Hungary and United Kingdom that have not been adopted in 2007 and therefore allowing for the first budget commitment in respect of the above operational programmes before the adoption of the Decision of the Commission approving the above operational programmes.

Considers that the budget and discharge procedures need to be viewed as complementary: a budget is not to be adopted without an analysis of the discharge decisions already adopted, and a decision on discharge must be taken on the basis of awareness of the political objectives set at the time of the budget procedure for the discharge year concerned; calls for further work on the interoperability of the budget and discharge procedures;

(11) In accordance with Articles 1 and 2 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark is not taking part in the adoption of this Decision and is not bound by it or subject to its application. Given that this Decision builds upon the Schengen acquis under the provisions of Title IV of Part Three of the Treaty establishing the European Community, Denmark has, in accordance with Article 5 of the said Protocol, to decide within a period of six months after the date of adoption of this Decision whether it will implement it in its national law.

Calls on the Council to adopt the framework decision on data protection, taking due account of the position unanimously adopted by the European Parliament; reaffirms that Parliament considers it essential for an appropriate framework decision on data protection under the third pillar to be adopted prior to adoption of the decision on the VIS and the regulation on the VIS;
