9. Notes with concern that in 2013 the Agency re-employed four temporary employees, whose contracts with the Agency had ended in 2013 after the maximum eight-year period, for a further eight-year period, contrary to its founding regulation; takes note that the proposal for a revised founding regulation for the Agency, which has not yet been adopted by Parliament and Council, includes similar provisions; finds unacceptable the Agency's breach of its own laws and rules and urges the Agency to respect its recruitment procedures;
9. s'inquiète de constater qu'en 2013, contrairement à ce que prévoit son règlement fondateur, l'Agence a réembauché, pour une nouvelle période de huit ans, quatre de ses agents temporaires dont les contrats étaient arrivés à échéance cette année-là après une durée de huit ans; constate que la proposition de révision de son règlement fondateur, que le Parlement et le Conseil n'ont pas encore adoptée, prévoit des dispositions qui vont dans ce sens; juge inacceptable la violation, par l'Agence, de ses propres lois et règles, et l'exhorte à respecter ses procédures de recrutement;

(a) make loans or pay contributions to any agency in respect of the cost of incorporating the agency or in respect of its operating expenses or make loans to any agency in respect of capital costs incurred by it; and

(2) Any action, suit or other legal or administrative proceeding to which the Canada Customs and Revenue Agency is a party that is pending on the coming into force of this section may be continued by or against the new agency in the same manner and to the same extent as it could have been continued by or against the Canada Customs and Revenue Agency in respect of those portions of the Canada Customs and Reve­nue Agency the control and supervision of which were transferred to the former agency by order P.C. 2003-2064.

Recognises the two comments made by the Court of Auditors which focus on the physical inventory and on the budgetary management; is at the same time also aware of the Agency's reply; points out that the carry-overs derive partly from the multi-annual nature, of IT development projects, partly from translations not delivered by year-end and the start of new biocides and PIC activities in the second half of the year; and welcomes therefore the agency's attempts to maximise the synergies between its tasks by making the best possible use of IT tools; reminds however the Agency to respect the annuality principle of the budget as close as possible; insists that the Agency completes as soon as possible the asset inventory exercise and to enforce the asset inventory management with the new version for ABAC assets; recognises at the same time that some shortfalls are legacy driven and arise from the set-up stage of the Agency when laptops and computers were provided through Commission framework contracts and have been used by Commission staff seconded to the Agency at that time; would like to mention that according to the Agency the untraced laptops from the early days have an overall residual value of EUR 5000;
3. prend acte des deux commentaires formulés par la Cour des comptes, qui concernent les stocks physiques et la gestion budgétaire; est également informé de la réponse de l'Agence; indique que les reports s'expliquent à la fois par la nature pluriannuelle des projets de développement informatique, par les traductions qui n'ont pas été livrées avant la fin de l'année et par le lancement de nouvelles activités relatives aux biocides et au consentement préalable en connaissance de cause au second semestre; salue par conséquent les efforts de l'Agence pour maximiser les synergies entre ses activités en tirant profit au mieux des outils informatiques; rappelle toutefois à l'Agence de respecter aussi fidèlement que possible le principe de l'annualité budgétaire; exige que l'Agence termine dès que possible l'inventaire des biens et mette en place une gestion des stocks basée sur la nouvelle version du système ABAC Assets; reconnaît également que l'absence du matériel manquant s'explique pas le fait que, dans la phase de création de l'Agence, les ordinateurs portables et de bureau étaient fournis via des contrats-cadre avec la Commission et étaient utilisés par le personnel de la Commission alors affecté à l'Agence; tient à préciser que, selon l'Agence, les tout premiers ordinateurs portables qui demeurent introuvables auraient une valeur résiduelle totale de 5 000 EUR;

5. Acknowledges in addition the Court of Auditors' observations that, following the entry into force of Regulation (EC) No 683/2008 of the European Parliament and of the Council of 9 July 2008 on the further implementation of the European satellite navigation programmes (EGNOS and Galileo) , most of the activities and assets related to the EGNOS and Galileo programmes were transferred to the Commission in December 2009 but at 31 December 2010 the status of EUR 2 000 000 held by the Agency in respect of technical support from the European Space Agency had still to be determined; notes from the Agency that the transfer of EUR 2 000 000 was finalised on 3 October 2011;
5. reconnaît en outre avec la Cour des comptes que, suite à l'entrée en vigueur du règlement (CE) n° 683/2008 du Parlement européen et du Conseil du 9 juillet 2008 relatif à la poursuite de la mise en œuvre des programmes européens de radionavigation par satellite (EGNOS et Galileo) , la plupart des activités et des actifs liés aux programmes EGNOS et Galileo ont été transférés à la Commission en décembre 2009 mais que, le 31 décembre 2010, le statut de 2 000 000 EUR détenus par l'Agence au titre du soutien technique de l'Agence spatiale européenne restait encore à déterminer; note que selon l'Agence, ce transfert de 2 000 000 EUR a été finalisé le 3 octobre 2011;

(3a) The fact that the discharge to the director of the agency in respect of the administrative budget is distinguished from the discharge in respect of the implementation by the agency of operational appropriations relating to Community programmes may endanger the clarity of the discharge procedure in the event of a proliferation of executive agencies.
(3 bis) Le fait qu'une distinction est établie entre la décharge à donner au directeur de l'agence en ce qui concerne le budget administratif et la décharge relative à l'exécution par l'agence des crédits opérationnels afférents aux programmes communautaires est de nature à compromettre la clarté de la procédure de décharge en cas de prolifération des agences exécutives.
