These Guidelines, adopted by the Joint Committee set up under Article 12 of the Agreement (the ‘Joint Committee’), aim at ensuring a harmonised implementation of the Agreement by the diplomatic missions and consular posts of the Member States of the Union (‘Member States’) and the Republic of Azerbaijan.
Les présentes lignes directrices, adoptées par le comité mixte institué en vertu de l'article 12 de l'accord (ci-après dénommé «comité mixte»), visent à garantir une mise en œuvre harmonisée de l'accord par les missions diplomatiques et les postes consulaires des États membres de l'Union (ci-après dénommés «États membres») et de la République d'Azerbaïdjan.

Unless otherwise agreed in the joint ownership agreement, each joint owner shall be entitled to grant non-exclusive licences to third parties to exploit the jointly owned results, without any right to sub-license, subject to the following conditions:
Sauf disposition contraire de l'accord de copropriété, chacun des copropriétaires est autorisé à concéder des licences non exclusives à des tiers pour exploiter les résultats objets de la copropriété, sans droit de concéder des sous-licences, sous réserve des conditions suivantes:

1. it transmit relevant information to Parliament on the joint scientific meetings provided for in Article 7 of the Partnership Agreement and on the changes to fishing conditions provided for in Article 8 of the Partnership Agreement, other Joint Committee meetings, specifically the minutes and conclusions, the annual report on the effective application of the multi-annual support programme referred to in Article 6 of the Agreement, and other documents considered relevant;
1. transmette au Parlement des informations pertinentes sur les réunions scientifiques conjointes prévues à l'article 7 de l'accord de partenariat et sur les changements des conditions de pêche prévues à l'article 8 de l'accord de partenariat, sur les autres réunions de la commission mixte, en particulier les procès-verbaux et les conclusions, ainsi que sur le rapport annuel sur la mise en œuvre efficace du programme de soutien sectoriel pluriannuel visé à l'article 6 de l'accord, et sur d'autres documents jugés pertinents;

In the same declaration, the Union, its Member States, Croatia and Iceland also stated, in line with Article 4(1) of the Kyoto Protocol which allows parties to fulfil their commitments under Article 3 of the Kyoto Protocol jointly, that Article 3(7 ter) of the Kyoto Protocol will be applied to the joint assigned amount pursuant to the agreement on joint fulfilment by the Union, its Member States, Croatia and Iceland and will not be applied to any Member State, Croatia or Iceland individually.

7. Recalls that, in accordance with Article 14 of the revised Cotonou Agreement, the joint institutions shall endeavour to ensure coordination, coherence and complementarity as well as an effective and reciprocal flow of information; is of the opinion that, as the President of the European Parliament is invited to the meetings of the European Council, the two Co-Presidents of the JPA should be given the opportunity to participate in the sessions of the Joint ACP-EU Council of Ministers; invites the Vice-President/High Representative to further improve the existing cooperation and ensure that the JPA is invited to participate in the next Joint Council;
7. rappelle que, conformément à l'article 14 de l'accord de Cotonou révisé, les institutions conjointes s'efforcent d'assurer la coordination, la cohérence et la complémentarité, ainsi qu'une circulation des informations efficace et réciproque; est d'avis, étant donné que le président du Parlement européen est invité aux réunions du Conseil européen, que les deux coprésidents de l'APP devraient avoir la possibilité de participer aux sessions du Conseil des ministres conjoint ACP-UE; invite la vice-présidente/haute représentante à améliorer encore la coopération existante et à s'assurer que l'APP est invitée à participer au prochain Conseil conjoint;

1. Union support under this Regulation shall focus on promoting enhanced political cooperation, deep and sustainable democracy, progressive economic integration and a strengthened partnership with societies between the Union and the partner countries and, in particular, the implementation of partnership and cooperation agreements, association agreements or other existing and future agreements, and jointly agreed action plans or equivalent documents.

Le soutien de l'Union prévu dans le cadre du présent règlement vise à promouvoir le renforcement de la coopération politique, une démocratie solide et durable, l'intégration économique progressive et le renforcement du partenariat avec les sociétés dans les relations entre l'Union et les pays partenaires et, en particulier, la mise en œuvre d'accords de partenariat et de coopération, d'accords d'association ou d'autres accords existants et à venir, ainsi que de plans d'action arrêtés d'un commun accord ou d'autres documents équivalents.

Unless otherwise agreed in the joint ownership agreement, each joint owner shall be entitled to directly exploit their jointly owned results, without requiring prior consent of the other joint owners.

72. Believes that information on private agreements between EU shipowners and third countries, as well as on joint ventures in third countries, including the number and type of vessels operating under such agreements and joint ventures, as well as their catches, should continue to be provided by the Member State to the Commission and made publicly available, subject to individual and commercial data protection rules, as laid down by the Fishing Authorisations Regulation;
72. est convaincu que les États membres doivent continuer à fournir à la Commission des informations sur les accords privés conclus entre les propriétaires de navires européens et des pays tiers et sur les associations d'entreprises créées dans des pays tiers, notamment concernant le nombre et le type de navires qui opèrent en vertu de ces accords et associations d'entreprises, ainsi que leurs captures, et que ces informations devraient être rendues publiques selon les règles de protection des données individuelles et commerciales, comme prévu par le règlement relatif aux autorisations pour les activités de pêche;

Article 101(1) of the Treaty on the Functioning of the European Union (TFEU) is not applicable to specialisation agreements * (including joint production agreements), provided the agreement does not contain any hardcore restrictions of competition and the parties' combined market share does not exceed 20 %.
L’article 101, paragraphe 1, du traité sur le fonctionnement de l’Union européenne (TFUE) ne s’applique pas aux accords de spécialisation * (y compris les accords de production conjointe), pour autant que ces accords ne contiennent pas de restrictions caractérisées de la concurrence et où la part cumulée des parties n’excède pas 20 %.
