On 15 December 1995, in response to several complaints, the Commission initiated proceedings pursuant to Article 93(2) of the EC Treaty against aid for the Aachen company Gemeinnützige Abfallverwertung GmbH (GAV).
Plusieurs plaintes ayant été déposées, la Commission a ouvert, le 15 décembre 1995, la procédure prévue à l'article 93, paragraphe 2, du traité, contre des aides en faveur de la société Aachener Unternehmens Gemeinnützige Abfallverwertung GmbH (ci-après dénommée «GAV»).

The annual subsidies totalling DEM 0,48 million in the period from 1992 to 1994 and the investment subsidy of DEM 2,7 million which were granted to Gemeinnützige Abfallverwertung GmbH (GAV) by the city of Aachen and by the Cologne government administrative district are unlawful aid pursuant to Article 93(3) of the EC Treaty, since they were not notified to the Commission in advance.
Les subventions annuelles dont le montant total s'est élevé à 0,48 million de marks allemands de 1992 à 1994 et la subvention à l'investissement de 2,7 millions de marks, qui ont été octroyées à l'entreprise Gemeinnützige Abfallverwertung GmbH (GAV) par la ville d'Aix-la-Chapelle et le Regierungspräsident de Cologne, sont illégales au sens de l'article 93, paragraphe 3, du traité car elles n'ont pas fait l'objet d'une notification préalable à la Commission.
