Urges all institutions, pending its desired revision, to apply Regulation (EC) No 1049/2001, and the subsequent jurisprudence, fully and to the letter and spirit, and to take into account the changes brought about by the Lisbon Treaty and the Charter of Fundamental Rights; calls, in particular, on the Council, including its preparatory bodies, to publish minutes of the meetings of Council working groups and other documents, in the light of the Access Info Europe case, intervening Member States and their proposals; calls on Parliament to make available the agendas and feedback notes of the meetings of Committee coordinators, the Bureau and the Conference of Presidents, as well as, in principle, all documents referred to in these agendas, in accordance with the provisions of Regulation (EC) No 1049/2001, by publishing them on the Parliament’s website.

Pending further coordination of consolidation methods, Member States shall provide that, where the parent undertaking of one or more institutions is a mixed-activity holding company, the competent authorities responsible for the authorisation and supervision of those institutions shall, by approaching the mixed-activity holding company and its subsidiaries either directly or via subsidiaries that are institutions, require them to supply any information which would be relevant for the purpose of supervising those subsidiaries.

Expresses concern that the amount of pending cases in the General Court is still very high in 2011 (i.e. 1300 pending cases in 2010 and 1308 pending cases in 2011); stresses the importance of the rapid administration of justice for the smooth operation not only of the institutions, but also of the economy because it increases legal certainty;

Host Member States shall retain responsibility in cooperation with the competent authorities of the home Member State for the supervision of the liquidity of the branches of credit institutions pending further coordination.

The effects of reorganisation measures or winding-up proceedings on a pending lawsuit concerning an asset or a right of which the credit institution has been divested shall be governed solely by the law of the Member State in which the lawsuit is pending.

12. Wishes to be informed about the level of sick leave of permanent and temporary staff in the institutions; has decided, therefore, to place 10% of the appropriations for auxiliary staff in the reserve, pending the submission of a joint report by the Secretaries-General of the institutions that is based on harmonised parameters, to allow comparability among the institutions; also requests the Secretaries-General to submit a report on the level of and reasons for secondment of officials to other institutions and to bodies outside the EU;
