Definition: The common themes that are shared by dissociative or conversion disorders are a partial or complete loss of the normal integration between memories of the past, awareness of identity and immediate sensations, and control of bodily movements. All types of dissociative disorders tend to remit after a few weeks or months, particularly if their onset is associated with a traumatic life event. More chronic disorders, particularly paralyses and anaesthesias, may develop if the onset is associated with insoluble problems or interpersonal difficulties. These disorders have previously been classified as various types of conversion hysteria . They are presumed to be psychogenic in origin, being associated closely in time with traumatic events, insoluble and intolerable problems, or disturbed relationships. The symptoms often represent the patient's concept of how a physical illness would be manifest. Medical examination and investigation do not reveal the presence of any known physical or neurological disorder. In addition, there is evidence that the loss of function is an expression of emotional conflicts or needs. The symptoms may develop in close relationship to psychological stress, and often appear suddenly. Only disorders of physical functions normally under voluntary control and loss of sensations are included here. Disorders involving pain and other complex physical sensations mediated by the autonomic nervous system are classified under somatization disorder (F45.0). Article 122 (9) provides that gains realised on the sale of ships are exempt from taxation provided that the ships sold have remained fixed assets of the company for more than five years at the time of sale and consequently that an amount at least equal to the sales value is re-invested within five years in the purchase of ships, co-ownership of ships, shares in ships or shares in shipping companies which have their headquarters in the Community and exclusively engage in eligible activities (10).

Il recommande aux compagnies de transport maritime d'instituer un "système de gestion de la sécurité" aux termes duquel ces compagnies : - établiront une politique en matière de sécurité d'exploitation de leurs navires et de protection de l'environnement, - définiront les responsabilités de toutes les personnes responsables, au sein de la compagnie et à bord des navires, de la sécurité de l'exploitation des navires et de la prévention de la pollution, ainsi que les relations entre ces personnes, - désigneront une personne responsable, au plus haut niveau, de la gestion de la sécurité et de la prévention de la pollution, - assureront que le personnel de sécurité à terre, les capitaines de leurs navires ainsi que les membres de l'équipage possèdent les qualifications requises et sont en mesure de communiquer entre eux sur les questions de sécurité, - définiront les instructions à observer à terre et à bord des navires, les procédures et exercices pour assurer la sécurité de l'exploitation des navires et pour permettre de réagir aux situations d'urgence, - prépareront des procédures de notification et d'analyse des irrégularités, des accidents et incidents potentiellement dangereux, - assureront de façon appropriée le maintien en état de leurs navires et de leurs armements, - établiront un "manuel de gestion de la sécurité", - évalueront régulièrement le système de gestion de la sécurité, - obtiendront une "attestation de conformité" délivrée par l'Etat du pavillon ou par le pays où opère la compagnie et certifiant que le système de gestion de la sécurité de la compagnie satisfait aux prescriptions du Code ISM, - obtiendront un "certificat de gestion de la sécurité" délivré par l'Etat du pavillon et certifiant que le système de gestion de la sécurité du navire satisfait aux prescriptions du Code ISM.

In accordance with that code the Regulation will oblige shipping companies to set up a "Safety Management System" under which they would: - establish a policy for the safe operation of its ships and the protection of the environment, - define the responsibilities of, and relations between, all persons responsible within the company and on board the ships for the safe operation of the ships and for pollution prevention, - designate a central person responsible for safe management and pollution prevention, - ensure that the safety personnel ashore, the masters of its ships and the crew are properly qualified and able to communicate with each other on safety matters, - define shorebound and on board instructions, procedures and drills for the safe operation of the ships and for the response to emergency situations, - prepare procedures for the reporting and analysis of non-conformities, accidents and hazardous situations, - ensure proper maintenance of its ships and its equipment, - establish a "Safety Management Manual", - regularly evaluate the SMS, - obtain a "Document of Compliance" issued by the flag State or by the country of operation and certifying that the SMS of the company complies with the ISM-Code, - obtain a "Safety Management Certificate" issued by the flag State and certifying that the SMS of the ship complies with the ISM-Code.

3. The Presidency calls upon the Commission to: (a) relay to the Council as soon as possible: - the outcome of its discussions with trade unions and professional organizations regarding the EUROS register, and - the result of the studies it has carried out on State aid in the shipping sector and on the link between such aid and the employment of Community crews; (b) submit a communication and appropriate proposals to promote the development of short-haul shipping within the Community; (c) examine the advisability of proposals for the establishment of minimum standards at Community level for the registration of ships in Member States' registers; (d) submit a communication on external relations in shipping, with a view to submitting guidelines on the matter to the Council defining general guidelines, action which should have priority regarding relations between the Community and third countries, and action to be taken within international bodies; (e) consider the need to reinforce or improve the application of the provisions of Regulations Nos 4057/86 and 4058/86 of 22 December 1986 on unfair practices and access to trans-ocean traffic; (f) consider ways of taking action to deal with ships sailing in Member States' waters where the shipping safety standards are not subject to effective control by the State of registration; (g) continue observing the impact of the application of competition rules to shipping, including multi-modal rate authority (h) submit a report on open registers, including an assessment as regards international law, and their impact on the situation of vessels flying the flag of a Member State.
3. La Présidence invite la Commission à : a) fournir au Conseil dès que possible : - le résultat des discussions qu'elle a eues avec les organisations syndicales et professionnelles au sujet du registre EUROS, ainsi que - le résultat des études auxquelles elle a procédé sur les aides d'Etat dans le secteur maritime et sur le lien entre ces aides et l'emploi des navigants communautaires ; b) soumettre sa communication et les propositions qu'elle comporte pour promouvoir le développement des transports maritimes de courte distance dans la Communauté ; c) examiner l'opportunité de propositions sur l'établissement au niveau communautaire de conditions minimales d'enregistrement des navires dans les registres des Etats membres ; d) présenter une communication sur les relations extérieures en matière de transports maritimes, en vue de soumettre au Conseil des lignes directrices en la matière, définissant les orientations générales, les actions prioritaires en matière de relations entre la Communauté et des pays tiers, ainsi que les actions à entreprendre au sein des instances internationales ; e) étudier la nécessité d'un renforcement ou d'une meilleure application des dispositions des règlements 4057/86 et 4058/86 du 22 décembre 1986 relatifs aux pratiques déloyales et à l'accès au trafic transocéanique ; f) mener une réflexion sur les moyens à mettre en oeuvre à l'égard des navires navigant dans les eaux dépendantes des Etats membres et dont les normes de sécurité maritime ne font pas l'objet de contrôles efficaces par leurs Etats d'immatriculation ; g) poursuivre l'observation des conséquences de l'application des règles de concurrence dans les transports maritimes, y compris l'autorisation de fixer des tarifs pour les transports multimodaux ; h) présenter un rapport sur les registres de libre immatriculation comportant leur évaluation sur le plan du droit international, ainsi que leur impact sur la situation des navires battant pavillon des Etats membres".
