5. By way of derogation from paragraphs 3 and 4, in the case of urgent preventive measures, where the examination referred to in paragraph 1 leads to a negative assessment and if the Member State concerned has not amended or repealed the national rule in question within 2 months of receipt of the opinion of the Agency, the Commission may adopt a decision, by way of implementing acts, requesting the Member State to amend or repeal that rule.
5. Par dérogation aux paragraphes 3 et 4, en cas de mesures préventives d'urgence, lorsque l'examen visé au paragraphe 1 donne lieu à une évaluation négative et si l'État membre concerné n'a pas modifié ou abrogé la règle nationale en question dans un délai de deux mois à compter de la réception de l'avis de l'Agence, la Commission peut adopter une décision, au moyen d'actes d'exécution, demandant à l'État membre de modifier ou d'abroger ladite règle.

(4) If a by-law, an amendment or a repeal is rejected by the shareholders, or if the directors do not submit a by-law, an amendment or a repeal to the shareholders as required under subsection (2), the by-law, amendment or repeal ceases to be effective and no subsequent resolution of the directors to make, amend or repeal a by-law having substantially the same purpose or effect is effective until it is confirmed or confirmed as amended by the shareholders.
