In placing section 182.1 and following right after section 182, Parliament was intending to create some special status for animals that derogates from their former status as property.

(34) In order to ensure uniform conditions for the implementation of this Regulation with respect to the list of Member States or parts thereof categorised in accordance with the conditions for derogating from certain conditions applicable to the non-commercial movement between Member States of equivalent status with regard to rabies of pet animals of the species listed in Part A of Annex I and with the rules concerning preventive health measures against diseases and infections other than rabies and the lists of third countries or territories for the purpose of derogating from certain non-commercial movement conditions, the model for the identification documents that are to accompany pet animals of the species listed in Annex I being moved for non-commercial purposes into a Member State from another Member State or from a third country or territory, safeguard measures in the event of the occurrence or spread of rabies, and the uniform application of information requirements, implementing powers should be conferred on the Commission.

49. Points to the concern among European citizens, expressed through their petitions to Parliament, about abuse of the derogations for un-stunned slaughtering in the EU; is particularly concerned that the current derogation for un-stunned slaughter is abused to a large extent in some Member States, to the detriment of animal welfare, of farmers and of consumers; urges the Commission to accelerate its evaluation on the labelling of meat from animals slaughtered without stunning and to present its report before 2013, following its commitment to undertake this evaluation in 2011; highlights that the question of consumers not being informed as to whether or not the meat they are buying is from animals slaughtered without stunning is an issue of great public interest for reasons of both transparency and animal suffering; underlines, however, that labelling is not an alternative to proper enforcement as it can only guide consumers if the information provided is verified and correct;

Gerald Chipeur, a lawyer specializing in constitutional law, who is well known to many of us, told us that by moving the provisions to a new part, Parliament could be considered to be intending to create some special status for animals that derogates from their former status as property.

Similarly, a derogation has been granted allowing fur animals to be fed with waste arising from the same species, subject to strict health conditions for the fur animals (eg TSE surveillance), ensuring the safety of the raw materials and processing standards, record keeping, official surveillance etc.

Traditional livestock farming activities should be supported in order to meet local consumption needs. To that end, derogations are needed from some of the provisions of the common market organisations which restrict production, to take account of the development and particular conditions of local production, which are quite different from those in the rest of the Community. This objective may also be pursued indirectly by financing genetic improvement programmes involving the purchase of pure-bred breeding animals, by purchasing commercial breeds more suited to local conditions, by supplementing the suckler cow premium and the slaughter premium, and by granting aid to develop cow's milk production and, where necessary, by making it possible to import from third countries male bovine animals for fattening, and to derogate from the application of the conditions governing imports of animals and animal feed provided for by Council Directive 72/462/EEC of 12 December 1972 on health and veterinary inspection problems upon importation of bovine animals and swine and fresh meat from third countries( ).

Il convient de soutenir les activités traditionnelles en matière d'élevage afin de satisfaire les besoins de la consommation locale; à cette fin, il convient de déroger à certaines dispositions des organisations communes de marchés en matières de limitation de la production pour tenir compte de l'état de développement et des conditions de production locales particulières et tout à fait différentes du reste de la Communauté; cet objectif peut être poursuivi, de façon complémentaire, par le financement de programmes d'amélioration génétique comportant l'achat d'animaux reproducteurs de race pure, par l'achat de races commerciales plus adaptées aux contextes locaux, par l'octroi de compléments à la vache allaitante et à l'abattage, et, dans l'attente du développement de l'élevage local, il convient, à titre temporaire et dans le cadre d'une limite maximale annuelle, pour ne pas compromettre l'objectif précité, de prévoir un approvisionnement en animaux mâles destinés à l'engraissement.

A derogation from this ban will apply on certain derived products provided they are produced using specifically defined processes; a programme for enforcement in Portugal of all EU and national measures, in particular those on the removal of SRMs and the feed ban, and regular reporting to the Commission on the results of this programme, as well as on the epidemiological situation.A provision to allow for triangular trade, i.e. the processing and re-export of bovine products from animals slaughtered outside Portugal, and derogation for certain products, is foreseen.
Une dérogation à cette interdiction sera appliquée à certains produits dérivés à condition qu'ils soient fabriqués selon des procédés bien définis; un programme de mise en oeuvre au Portugal de l'ensemble des mesures nationales et communautaires concernant notamment l'enlèvement des MRS et l'interdiction de l'utilisation dans l'alimentation animale, ainsi qu'un rapport transmis régulièrement à la Commission sur les résultats de ce programme et la situation épidémiologique.

9. The following sentence is added to the last subparagraph of Article 6(4): However, in accordance with the procedure laid down in Article 29 of Regulation (EEC) No 4253/88, the Commission may authorize a Member State to derogate from that condition, in exceptional cases and solely for investment to reduce emissions from animal droppings and the elimination of slurry in existing holdings, provided that such investment leads to a better result for the protection of the environment than that obtained by the condition derogated from and that it does not in any circumstances lead to an increase in production capacity.
9. Article 6, 4, dernier alinéa, la phrase suivante est ajoutée : Toutefois, selon la procédure prévue à l'article 29 du règlement (CEE) nu 4253/88, la Commission peut autoriser un Etat membre à déroger à cette condition, dans des cas exceptionnels et exclusivement pour les investissements visant la réduction des émissions provenant des déjections animales et l'élimination du lisier dans des exploitations existantes, pour autant que ces investissements aboutissent à un meilleur résultat pour la protection de l'environnement que celui obtenu par la condition dérogée et que, en aucun cas, portent à une augmentation de la capacité de production.
