While there is no mandatory requirement in the Directive for consultation at the screening stage, the fact that the competent authority may need to consider, on the basis of Annex III, areas outside of its own expertise, would suggest that some consultation with expert bodies may be necessary.

The list of areas of Union acts currently supported by IMI is set out in Annex I. Areas of possible future expansion are listed in Annex II. The Rapporteur believes the modification of the scope is an essential element of the proposal and thus recommends that any extension of the scope of IMI in the future should be subject to a new regulation proposal. As a result, the Rapporteur proposes to delete the reference to delegated acts and, as a consequence, also Annex II.

1a. In order to simplify the administration and in order to take account of the specificities of the types of ecological focus area listed in paragraph 1 and to facilitate their measurement, Member States may, when calculating the total hectares represented by the ecological focus area of the holding, make use of the conversion and/or weighting factors set out in Annex VIb. If a Member State decides to consider as ecological focus area the area under point (l) of paragraph 1 or any other area that is subject to a weighting of less than 1, the use of the weighting factors set out in Annex VIb shall be mandatory.

The Member States shall submit to the Commission in electronic format, not later than . , a list of vessels flying their flag that had a track record of fishing during the year 2008 in the area referred to in Article 4 and in GFCM Geographical Sub-Area 7 as defined in Annex I. The list shall contain the name of the vessel, its number in the Fleet Register, referred to in Annex I to Commission Regulation (EC) No 26/2004 of 30 December 2003 on the Community fishing fleet register , the period for which the vessel was authorised to fish in the area referred to in Article 4 and the number of days spent by each vessel in the year 2008 in Geographical Sub-Area 7, and more specifically in the area referred to in Article 4.

Notwithstanding section 1 of this Annex, for areas that are not encompassed within the definition of ‘territory’ in Article 1 of this Agreement, the agreements in paragraphs (e) (Denmark–United States), (g) (France–United States), and (v) (United Kingdom–United States) of that section shall continue to apply, according to their terms.

7.6. The scope of the ordinary legislative procedure has been substantially expanded: some 50 new legal bases (bringing the total to 86), some of which are of enormous importance, such as those concerning the area of freedom, security and justice, policy on agriculture and fisheries, the European research area, the definition of implementing powers (hitherto governed by the framework decision on comitology) or the current Financial Regulation (cf. Annex 3).
7.6.
